【摘要】：通過(guò)緝毒偵查來(lái)打擊毒品犯罪活動(dòng),是解決毒品問(wèn)題泛濫的最直接手段。由于毒品犯罪案件是隱性案件,一般沒(méi)有明確的犯罪現(xiàn)場(chǎng),也沒(méi)有特定的報(bào)案人、受害人,具有明顯的智能化、網(wǎng)絡(luò)化、隱蔽化特征,犯罪手段又多種多樣,增加了偵查發(fā)現(xiàn)的難度。收集、獲取毒品犯罪證據(jù)是緝毒偵查的關(guān)鍵環(huán)節(jié),也是確保打擊效果的前提,但毒品犯罪的證據(jù)類(lèi)型單一、即時(shí)性強(qiáng)、容易毀壞,導(dǎo)致毒品犯罪證據(jù)發(fā)現(xiàn)難、收集難、認(rèn)定難,成為一直困擾司法部門(mén)的難題。在毒品犯罪案件中應(yīng)用電子取證技術(shù),可以豐富偵查手段,拓寬證據(jù)類(lèi)型,成為解決毒品犯罪案件偵查發(fā)現(xiàn)難、證據(jù)來(lái)源少、取證困難的一種利器。因此,在當(dāng)前信息社會(huì)背景下,開(kāi)展毒品犯罪案件中電子取證技術(shù)研究,對(duì)提高打擊成效、遏制毒品蔓延具有重要的實(shí)踐意義。論文根據(jù)毒品犯罪案件的特點(diǎn),利用電子取證技術(shù)的理論和方法,開(kāi)展電子取證技術(shù)在毒品犯罪案件中的應(yīng)用研究。主要研究?jī)?nèi)容如下： 論文總結(jié)了國(guó)內(nèi)外電子取證技術(shù)的研究現(xiàn)狀,分析電子取證技術(shù)在禁毒領(lǐng)域的實(shí)際應(yīng)用情況,針對(duì)應(yīng)用過(guò)程中存在的系統(tǒng)性研究成果不多、取證與偵查脫節(jié)、取證缺乏主動(dòng)性等不足,結(jié)合毒品犯罪案件的規(guī)律特點(diǎn),專(zhuān)題研究電子取證技術(shù)在毒品犯罪案件中的應(yīng)用,系統(tǒng)歸納毒品犯罪案件中電子證據(jù)的來(lái)源和分類(lèi),對(duì)常見(jiàn)的手機(jī)證據(jù)、網(wǎng)上交易證據(jù)、電子郵件證據(jù)和網(wǎng)絡(luò)聊天證據(jù)的取證方法進(jìn)行了詳細(xì)分析。 針對(duì)司法實(shí)踐的需求,利用靜態(tài)取證技術(shù)和動(dòng)態(tài)取證技術(shù),進(jìn)行毒品犯罪案件電子證據(jù)綜合取證分析模型設(shè)計(jì)研究,設(shè)計(jì)了一種適合毒品犯罪案件調(diào)查取證的分析模型。該模型從毒品犯罪案件入手,逐一分析了數(shù)據(jù)收集、數(shù)據(jù)處理、數(shù)據(jù)分析、證據(jù)提取以及證據(jù)提交各模塊的功能和實(shí)現(xiàn)過(guò)程,并把蜜罐技術(shù)的思想和誘惑偵查手段相結(jié)合,提高了打擊毒品犯罪活動(dòng)的主動(dòng)性。在此基礎(chǔ)上,設(shè)計(jì)了一種適合毒品犯罪案件偵查與取證的系統(tǒng)架構(gòu)。
[Abstract]:The most direct way to solve the problem of drug abuse is to crack down on drug crime through drug detection. Because drug crime cases are hidden cases, there is generally no clear crime scene, no specific informant, no victim, with obvious intelligence, networking, covert characteristics, and a variety of criminal methods. It increases the difficulty of detection. Collecting and obtaining evidence for drug-related crimes is a key link in drug detection and also a prerequisite for ensuring the effectiveness of the crackdown. However, the type of evidence for drug-related crimes is single, immediate and easy to destroy, leading to the difficulty of finding, collecting, and determining evidence for drug-related crimes. It has been a difficult problem for the judiciary. The application of electronic forensics in drug crime cases can enrich the investigative techniques, widen the types of evidence, and become a sharp weapon to solve the problem of difficult investigation and discovery of drug crime cases, less sources of evidence and difficulty in obtaining evidence. Therefore, under the background of the current information society, it is of great practical significance to carry out the research on electronic forensics in drug crime cases to improve the effectiveness of the crackdown and to curb the spread of drugs. According to the characteristics of drug crime cases, this paper makes use of the theory and method of electronic forensics to study the application of electronic forensics in drug crime cases. The main research contents are as follows: this paper summarizes the current research situation of electronic forensics technology at home and abroad, analyzes the actual application of electronic forensics technology in the field of drug control, aiming at the lack of systematic research results in the process of application. Evidence collection and investigation, lack of initiative and other deficiencies, combined with the characteristics of the law of drug crime cases, special research on the application of electronic forensics in drug crime cases, systematically summed up the source and classification of electronic evidence in drug crime cases, The common evidence of mobile phone, online transaction, e-mail and internet chat are analyzed in detail. In order to meet the needs of judicial practice, this paper studies the design of a comprehensive forensic analysis model for electronic evidence in drug crime cases by using static and dynamic forensics techniques, and designs an analytical model suitable for the investigation and collection of drug crime cases. Starting with drug crime cases, the model analyzes the functions and implementation process of each module of data collection, data processing, data analysis, evidence extraction and evidence submission, and combines honeypot technology with the means of enticement investigation. We have increased our initiative in cracking down on drug crimes. On this basis, a system structure suitable for drug crime investigation and evidence collection is designed.
