【摘要】：與一般的詐騙犯罪相比,網(wǎng)絡(luò)電信詐騙犯罪有著自身獨(dú)特的屬性,其案件分布廣泛,案件紛繁復(fù)雜且偵破難度系數(shù)較大,其社會(huì)危害性不言而喻。文章首先通過網(wǎng)絡(luò)電信詐騙的起源與發(fā)展,現(xiàn)狀以及網(wǎng)絡(luò)電信詐騙成因等特點(diǎn),進(jìn)行了詳細(xì)的剖析,得出了網(wǎng)絡(luò)電信詐騙出現(xiàn)的根源并對(duì)犯罪分子常用的犯罪手段和操作步驟進(jìn)行了羅列。其次,本文重點(diǎn)對(duì)網(wǎng)絡(luò)電信詐騙犯罪中常遇見的困難進(jìn)行了闡述和討論,其中重點(diǎn)分析以公安機(jī)關(guān)機(jī)關(guān)偵破案件的角度在打擊網(wǎng)絡(luò)電信詐騙犯罪中的難點(diǎn)和困難。再次,簡(jiǎn)述了域外國家地區(qū)在防范網(wǎng)絡(luò)電信詐騙的措施,向讀者重點(diǎn)介紹了德美日及我國臺(tái)灣地區(qū)政府職能部門采取的手段和成效。最后,筆者結(jié)合域外國家地區(qū)打擊網(wǎng)絡(luò)電信詐騙犯罪的經(jīng)驗(yàn)技術(shù),就我國公安機(jī)關(guān)以及社會(huì)各界怎樣打擊和預(yù)防網(wǎng)絡(luò)電信詐騙犯罪總結(jié)了若干專業(yè)對(duì)策和常規(guī)對(duì)策。在現(xiàn)有的制度體系和環(huán)境下,公安機(jī)關(guān)應(yīng)建立網(wǎng)絡(luò)電信詐騙的預(yù)防、控制打擊平臺(tái),從電信通訊及資金鏈方面進(jìn)一步重創(chuàng)網(wǎng)絡(luò)電信詐騙犯罪,利用現(xiàn)有的偵查條件,提出能夠應(yīng)用在實(shí)踐中的可操作性強(qiáng)的方式和方法。借此能夠從根本上解決偵辦網(wǎng)絡(luò)電信詐騙案件中遇到困難,占據(jù)偵破案件的主動(dòng),堅(jiān)決遏制網(wǎng)絡(luò)電信詐騙蔓延的勢(shì)頭。最大程度地減少財(cái)產(chǎn)損失,保障人民群眾財(cái)產(chǎn)安全,切實(shí)維護(hù)社會(huì)穩(wěn)定。
[Abstract]:Compared with the common fraud crime, the network telecommunication fraud crime has its own unique attribute, its case distribution is widespread, the case is complicated and the detection difficulty coefficient is large, its social harmfulness is self-evident. First of all, through the origin and development of network telecom fraud, the present situation and the causes of network telecom fraud, the article makes a detailed analysis. The origin of network telecom fraud is obtained, and the common criminal means and operation steps are listed. Secondly, this paper focuses on the network telecom fraud crime often encountered in the elaboration and discussion, in which the focus of public security organs to solve the case in the fight against network telecommunications fraud crime difficulties and difficulties. Thirdly, the paper briefly introduces the measures taken by foreign countries to prevent network telecom fraud, and introduces the measures and results adopted by the government departments of Germany, the United States, Japan and Taiwan. Finally, the author summarizes some professional and conventional countermeasures on how to crack down and prevent the crime of network telecommunication fraud in China's public security organs and social circles in combination with the experience and technology of foreign countries in cracking down on the crime of network telecommunication fraud. Under the existing system and environment, the public security organs should establish the prevention of network telecommunication fraud, control the attack platform, further damage the network telecommunication fraud crime from the telecommunication communication and fund chain, and make use of the existing investigation conditions. Put forward the feasible way and method that can be applied in practice. Thus it can fundamentally solve the difficulties encountered in the investigation of network telecom fraud cases, occupy the initiative to solve the cases, and resolutely curb the momentum of the spread of network telecom fraud cases. To minimize property losses, ensure the safety of people's property, and effectively maintain social stability.
