【摘要】： 改革開放以來,我國公安執(zhí)法監(jiān)督的措施、方法、體系得到了不斷的發(fā)展,初步形成了具有中國特色的警察權(quán)力監(jiān)督制約體系,但從警察權(quán)力監(jiān)督制約體系的現(xiàn)狀來看還很不完善,加上新舊經(jīng)濟體制轉(zhuǎn)換、政府職能的轉(zhuǎn)變,對警察權(quán)力的監(jiān)督制約尚存在諸多缺陷。如何在保障警察權(quán)的同時有效地約束警察權(quán)、防止警察權(quán)的濫用,為市場經(jīng)濟的發(fā)展創(chuàng)造一個良好的社會環(huán)境和調(diào)控環(huán)境,無疑成了一個需要盡速完成的、富有實踐意義的重要課題。 公安機關(guān)作為國家重要的執(zhí)法機關(guān),既具有一定的刑事司法權(quán),又具有一定的治安行政權(quán),其權(quán)力涉及到社會管理的各個方面�，F(xiàn)實生活中,警察隊伍中存在的不正之風現(xiàn)象仍相當嚴重,一些違法亂紀的問題相當突出,腐敗現(xiàn)象亦有愈演愈烈之勢。這些問題將嚴重地損害警察的聲譽和形象,破壞了本應良好的警民關(guān)系,干擾了公安工作的正常開展。因此,新形勢下如何使警察保持公正廉潔,如何加強警察隊伍建設是一個亟待解決的問題。而解決該問題的有效途徑之一就是進一步建立和完善現(xiàn)有的警察執(zhí)法監(jiān)督體制,強化對權(quán)力的制約,以加強廉政建設。 為了確保公安機關(guān)在法律規(guī)定的范圍內(nèi)嚴格依法行政,保障公安機關(guān)及其人民警察依法履行職責、行使職權(quán),維護公民的合法權(quán)益,對公安執(zhí)法的監(jiān)督顯得尤為重要。筆者作為一名從事公安執(zhí)法工作的人員,在借鑒法學學者的研究成果的基礎上,通過探析公安機關(guān)執(zhí)法監(jiān)督的主體、客體、構(gòu)成及現(xiàn)狀,總結(jié)概括了公安執(zhí)法監(jiān)督的概念、特點及意義,針對當前公安執(zhí)法監(jiān)督中存在的成本問題、權(quán)威性問題、責任追究問題及內(nèi)外執(zhí)法監(jiān)督等問題,結(jié)合國內(nèi)外警察執(zhí)法機制的借鑒,在理論聯(lián)系實際的基礎上,對當前公安執(zhí)法監(jiān)督中存在的突出問題進行調(diào)研分析,就如何完善監(jiān)督機制,最終提出了建立、健全公安執(zhí)法監(jiān)督機制的一些可行性措施,豐富了公安機關(guān)執(zhí)法監(jiān)督的一般性理論研究,以求進一步完善我國現(xiàn)行公安執(zhí)法監(jiān)督機制。
[Abstract]:Since the reform and opening up, the measures, methods and systems of public security law enforcement and supervision in China have been continuously developed, and a police power supervision and restriction system with Chinese characteristics has been initially formed. However, from the current situation of police power supervision and restriction system, it is still very imperfect. In addition, the transformation of new and old economic system and the transformation of government functions, there are still many defects in the supervision and restriction of police power. How to effectively restrain the police power while safeguarding the police power, prevent the abuse of the police power, and create a good social and regulatory environment for the development of the market economy has undoubtedly become a task that needs to be completed as soon as possible. An important subject of practical significance. As an important law enforcement organ of the country, public security organ not only has certain criminal judicial power, but also has certain administrative power of public security. Its power involves all aspects of social management. In real life, the phenomenon of malpractice in the police force is still quite serious, some problems of violating the law and discipline are quite prominent, and the phenomenon of corruption is becoming more and more serious. These problems will seriously damage the reputation and image of the police, destroy the relationship between the police and the people, and interfere with the normal development of public security work. Therefore, how to keep the police fair and clean under the new situation and how to strengthen the construction of the police force is an urgent problem to be solved. One of the effective ways to solve this problem is to further establish and improve the existing police law enforcement supervision system, strengthen the power constraints, in order to strengthen the building of a clean government. In order to ensure that the public security organs strictly administer according to the law, ensure that the public security organs and the people's police perform their duties according to law, exercise their functions and powers, and safeguard the legitimate rights and interests of citizens, it is particularly important to supervise the law enforcement by public security organs. As a person engaged in public security law enforcement, based on the research results of legal scholars, the author summarizes the concept of public security law enforcement supervision by analyzing the subject, object, constitution and present situation of public security organ law enforcement supervision. In view of the cost problem, authority problem, responsibility investigation problem and internal and external law enforcement supervision problems existing in the current police law enforcement supervision, combined with the reference of the domestic and foreign police law enforcement mechanism, and on the basis of integrating theory with practice, On the basis of investigation and analysis of the outstanding problems existing in the supervision of public security law enforcement at present, some feasible measures for establishing and perfecting the supervision mechanism of public security law enforcement are put forward on how to perfect the supervision mechanism. It enriches the general theoretical research on the supervision of law enforcement by public security organs in order to further improve the current mechanism of law enforcement supervision in our country.
