【摘要】： 最近,公安部部長孟建柱多次提出,破大案與破小案要一同兼顧,在建設(shè)和諧社會的時代背景下,“破小案”已經(jīng)成為各地公安機關(guān)實際工作中的一項重要政策。破小案這項政策是對嚴打以來,特別是“命案必破”等強調(diào)刑偵工作的重心是大要件偵查的具體刑事政策的調(diào)整和轉(zhuǎn)向。本文擬對破小案刑事政策的內(nèi)涵、價值和意義予以探討,并對其與嚴打進行比較研究,最后是在刑法學(xué)、公共政策、偵查成本與效益等角度做了較深刻的分析。
[Abstract]:Recently, Meng Jianzhu, minister of public security, has repeatedly proposed that both major and minor cases should be solved together, and in the context of building a harmonious society, "solving minor cases" has become an important policy in the actual work of local public security organs. The policy of solving minor cases is the adjustment and turn of the specific criminal policy that emphasizes that the focus of criminal investigation work is the major element of investigation since the severe strike, especially the "murder case must be solved". This paper discusses the connotation, value and significance of the criminal policy of solving minor cases, and makes a comparative study of it and severe strike. Finally, it makes a deep analysis in the angle of criminal law, public policy, investigation cost and benefit.
