【摘要】：當(dāng)前,我國(guó)社會(huì)發(fā)展已進(jìn)入國(guó)際上公認(rèn)的敏感時(shí)期,新機(jī)遇與新挑戰(zhàn)并存。其中,伴隨著社會(huì)矛盾的日益凸顯和公民權(quán)利意識(shí)的日漸覺醒,越來越多的群體性事件已經(jīng)成為影響我國(guó)社會(huì)穩(wěn)定最為突出的問題。武警部隊(duì)作為國(guó)家武裝力量的重要組成部分,參與處置大規(guī)模群體性事件是武警部隊(duì)履行維護(hù)國(guó)家安全和社會(huì)穩(wěn)定、保障人民群眾安居樂業(yè)神圣使命的一項(xiàng)中心任務(wù)。群體性事件嚴(yán)重影響公共秩序和社會(huì)穩(wěn)定,武警部隊(duì)作為維護(hù)社會(huì)穩(wěn)定的重要力量,在參與處置群體性事件時(shí),必須通過分析事件發(fā)生的原因、判定事件的性質(zhì)、理解把握處置的原則理解、運(yùn)用處置的策略戰(zhàn)術(shù),妥善處置群體性事件。因此,有必要對(duì)武警部隊(duì)參與處置群體性事件的相關(guān)情況進(jìn)行梳理,為進(jìn)一步提高武警部隊(duì)依法參與處置群體性事件、提高處置行動(dòng)效率提供借鑒。 當(dāng)前,武警部隊(duì)在處置群體性事件時(shí)面臨諸多執(zhí)法難點(diǎn),在處理事件中還有許多問題有待解決。本文從武警部隊(duì)參與處置群體性事件的理論基礎(chǔ)入手,對(duì)群體性事件的概念特點(diǎn)、理論依據(jù)和法理依據(jù)進(jìn)行了梳理,使武警部隊(duì)參與處置群體性事件的必要性、合法性和正當(dāng)性得以彰顯；通過研讀大量案例,對(duì)武警部隊(duì)參與處理群體性事件的基本經(jīng)驗(yàn)進(jìn)行總結(jié),發(fā)現(xiàn)武警部隊(duì)在參與處置群體性事件中存在的主要問題,并對(duì)這些問題的原因進(jìn)行分析,以期對(duì)武警部隊(duì)參與處置群體性事件的現(xiàn)狀有了一個(gè)宏觀、全面、準(zhǔn)確的了解；針對(duì)武警部隊(duì)參與處置群體性事件中存在的主要問題,著眼提高武警部隊(duì)執(zhí)法能力,結(jié)合武警四川總隊(duì)實(shí)際,從“練強(qiáng)內(nèi)功”和“優(yōu)化外部環(huán)境”兩個(gè)角度,提出了充分做好準(zhǔn)備、正確界定事件性質(zhì)、準(zhǔn)確把握處置的政策依據(jù)和處置策略、完善法制環(huán)境、優(yōu)化社會(huì)環(huán)境五個(gè)方面的對(duì)策和建議,吸收了已有的經(jīng)驗(yàn),反映了發(fā)展的趨勢(shì)。其中,通過對(duì)新頒發(fā)的《人民武裝警察法》進(jìn)行解讀和闡述,提出了進(jìn)一步貫徹落實(shí)的設(shè)想,對(duì)完善武警部隊(duì)參與處置群體性事件的法制環(huán)境提供了參考;通過總結(jié)武警四川總隊(duì)與駐地開展的警地“雙平安”活動(dòng)的基本做法,從構(gòu)建和諧社會(huì)、營(yíng)造“大平安”社會(huì)環(huán)境的高度,對(duì)深化這一活動(dòng)提出了初步構(gòu)想和建議,進(jìn)一步優(yōu)化社會(huì)化境,是從根本上解決武警部隊(duì)參與處置群體性事件主要難題的治本之策。 本文主要通過對(duì)武警部隊(duì)參與處置群體性事件的相關(guān)理論、基本現(xiàn)狀、主要問題和原因進(jìn)行研究分析,得出進(jìn)一步改進(jìn)武警部隊(duì)參與處置群體性事件的策略的對(duì)策建議,為減少武警部隊(duì)參與處置群體性事件的風(fēng)險(xiǎn)、提高處置效率做一些有益的探索。
[Abstract]:At present, China's social development has entered an internationally recognized sensitive period in which new opportunities and challenges coexist. With the increasing prominence of social contradictions and the awakening of civil rights awareness, more and more mass incidents have become the most prominent problem affecting China's social stability. Participation in handling mass incidents is an important part of the sacred mission of the Armed Police Force to safeguard national security and social stability and to ensure the people's living and working in peace and contentment. When a group event occurs, it is necessary to analyze the causes, determine the nature of the event, understand and grasp the principles of handling it, use the tactics and tactics of handling it, and properly handle it. To provide reference for dealing with group incidents and improving the efficiency of disposal actions.
At present, the armed police force is facing many difficulties in dealing with mass incidents, and there are still many problems to be solved in dealing with the incidents. Starting from the theoretical basis of the armed police force's participation in dealing with mass incidents, this paper sorts out the conceptual characteristics, theoretical basis and legal basis of mass incidents, so as to enable the armed police force to participate in the disposal group. The necessity, legitimacy and legitimacy of physical incidents have been highlighted; by studying a large number of cases, this paper summarizes the basic experience of the armed police forces in dealing with mass incidents, finds out the main problems existing in the armed police forces'participation in dealing with mass incidents, and analyzes the causes of these problems, with a view to the participation of the armed police forces. The present situation of mass incidents has a macroscopic, comprehensive and accurate understanding; in view of the main problems existing in the participation of the armed police forces in handling mass incidents, with a view to improving the law enforcement capability of the armed police forces, combined with the actual situation of the armed police forces in Sichuan, from the two perspectives of "strengthening internal skills" and "optimizing the external environment", the full preparation has been put forward. Correctly defining the nature of the incident, accurately grasping the policy basis and disposal strategy, perfecting the legal environment, optimizing the social environment, the countermeasures and suggestions of five aspects, absorbing the existing experience, reflecting the development trend. The tentative plan provides a reference for perfecting the legal environment in which the armed police force participates in dealing with mass incidents; by summarizing the basic practices of the activities of "double peace" between the Sichuan Armed Police Corps and the police stations, and from the height of building a harmonious society and creating a "great peace" social environment, it puts forward some preliminary ideas and suggestions for deepening the activities. One step to optimize the socialized environment is the fundamental solution to the main problem of the armed police forces involved in dealing with mass incidents.
In this paper, through the study and analysis of the relevant theories, the basic status quo, the main problems and the causes of the armed police forces'participation in dealing with mass incidents, the countermeasures and suggestions for further improving the strategies of the armed police forces' participation in dealing with mass incidents are put forward, so as to reduce the risk of the armed police forces'participation in dealing with mass incidents and improve the efficiency of dealing with them.
