【摘要】：被害人危險接受理論的主要內(nèi)容是客觀不法排除,同時又以危險的優(yōu)越認(rèn)知理論作為其補充。這導(dǎo)致其陷入體系性和邏輯性的困境。其實,無論是自我答責(zé)原理、被害人教義學(xué)等法哲學(xué)理論,還是共犯從屬性套用理論、構(gòu)成要件范圍理論等均無法自圓其說。擺脫該困境的唯一辦法是將歸責(zé)排除的路徑從客觀方面轉(zhuǎn)換至主觀方面,即排除歸責(zé)的根據(jù)是行為人對被害人自我保護的合理信賴。即使行為人認(rèn)識到被害人接受危險,但如果從規(guī)范目的或者社會交往規(guī)范看仍無法合理信賴被害人能夠避免損害,那么行為人仍應(yīng)對損害結(jié)果承擔(dān)刑事責(zé)任。
[Abstract]:The main content of the theory of victim's danger acceptance is the objective illegal exclusion, and at the same time, it is supplemented by the dangerous superior cognitive theory. This led to its systemic and logical dilemma. In fact, no matter the principle of self-answer, the doctrine of victim dogmatics, or the theory of accomplice application, the theory of the scope of constitutive elements can not justify itself. The only way to get rid of this dilemma is to change the way of exclusion of imputation from objective aspect to subjective aspect, that is to say, the basis of excluding imputation is the reasonable trust of the actor to the victim's self-protection. Even if the actor realized that the victim accepted the danger, if he could not reasonably trust the victim to avoid the damage from the view of the normative purpose or the norms of social communication, the actor should still bear criminal responsibility for the result of the damage.
