【摘要】： 道路交通安全管理非現(xiàn)場(chǎng)執(zhí)法是公安交警部門利用現(xiàn)代科技手段查獲道路上機(jī)動(dòng)車(主要是汽車)違法行為,通過技術(shù)監(jiān)控設(shè)備固定違法證據(jù),傳輸至后臺(tái)計(jì)算機(jī)信息系統(tǒng)進(jìn)行處理,據(jù)以確定違法車輛,并在事后對(duì)車輛所有人或管理人依法予以處罰的一種道路交通安全行政管理方式。目前,道路交通安全管理非現(xiàn)場(chǎng)執(zhí)法被公安交警部門廣泛采用,并在維護(hù)交通秩序中發(fā)揮了重要作用,與此同時(shí),這一執(zhí)法方式存在的問題也引發(fā)了不少爭(zhēng)議,對(duì)這一執(zhí)法方式的法律依據(jù)、法律程序、法律價(jià)值以及存在問題進(jìn)行系統(tǒng)性地深入研究,對(duì)于進(jìn)一步規(guī)范交警的非現(xiàn)場(chǎng)執(zhí)法行為,以及促進(jìn)警察行政法治的理論研究和實(shí)踐具有一定的現(xiàn)實(shí)意義。本文主要從行政法和法理學(xué)的視角,對(duì)道路交通安全管理非現(xiàn)場(chǎng)執(zhí)法的理論和實(shí)踐進(jìn)行一些探討。 正文第一章闡明非現(xiàn)場(chǎng)執(zhí)法的基本概念,分析基本法律屬性和專有特征,并簡(jiǎn)要對(duì)比這一執(zhí)法方式在國(guó)內(nèi)外的應(yīng)用現(xiàn)狀。第二章對(duì)非現(xiàn)場(chǎng)執(zhí)法的主要方法和相關(guān)程序進(jìn)行歸納和剖析。第三章從正面對(duì)非現(xiàn)場(chǎng)執(zhí)法的合法性、合理性進(jìn)行分析,闡述非現(xiàn)場(chǎng)執(zhí)法在保障生命安全、維護(hù)交通秩序、提高行政效能、促進(jìn)執(zhí)法平等、養(yǎng)成守法習(xí)性五個(gè)方面的正義價(jià)值。第四章主要圍繞執(zhí)法的程序、證據(jù)力、實(shí)體處置、執(zhí)法監(jiān)督以及執(zhí)法主體適格性方面,從實(shí)務(wù)上分析目前交警非現(xiàn)場(chǎng)執(zhí)法過程中存在的一些問題。第五章針對(duì)非現(xiàn)場(chǎng)執(zhí)法存在的問題從立法、執(zhí)法以及實(shí)務(wù)環(huán)節(jié)應(yīng)注意的問題提出一些對(duì)策和建議,并就加強(qiáng)交警執(zhí)法隊(duì)伍建設(shè)等提出一些設(shè)想。
[Abstract]:Non-site law enforcement of road traffic safety management is the use of modern scientific and technological means by public security traffic police departments to seize illegal acts of motor vehicles (mainly automobiles) on roads, and to fix illegal evidence through technical monitoring equipment. A road traffic safety administrative management mode which is transmitted to the backstage computer information system to determine the illegal vehicle and punish the owner or manager of the vehicle according to the law. At present, the off-site law enforcement of road traffic safety management is widely used by the public security traffic police departments, and it plays an important role in maintaining traffic order. At the same time, the problems existing in this law enforcement method have also caused a lot of controversy. The legal basis, the legal procedure, the legal value and the existing problems of this law enforcement method are systematically and deeply studied, so as to further standardize the off-site law enforcement behavior of the traffic police. And to promote the police administrative rule of law theoretical research and practice has certain practical significance. From the perspective of administrative law and jurisprudence, this paper discusses the theory and practice of off-site law enforcement in road traffic safety management. The first chapter clarifies the basic concept of off-site law enforcement, analyzes the basic legal attributes and exclusive characteristics, and briefly compares the current situation of the application of this law enforcement method at home and abroad. The second chapter summarizes and analyzes the main methods and related procedures of off-site law enforcement. The third chapter analyzes the legitimacy and rationality of off-site law enforcement from the positive, and expounds the justice value of off-site law enforcement in five aspects: ensuring life safety, maintaining traffic order, improving administrative efficiency, promoting the equality of law enforcement, and cultivating law-abiding habits. The fourth chapter mainly focuses on the procedure of law enforcement, evidence power, entity disposal, law enforcement supervision and the suitability of law enforcement subject, and analyzes some problems existing in the current off-site law enforcement process of traffic police from the practical point of view. The fifth chapter puts forward some countermeasures and suggestions for the problems existing in off-site law enforcement from the aspects of legislation, law enforcement and practical links, and puts forward some suggestions on strengthening the construction of traffic police law enforcement team.
