【摘要】： 競(jìng)技體育是以競(jìng)技比賽為主要特征,以創(chuàng)造優(yōu)異成績(jī)?yōu)槟繕?biāo)的體育活動(dòng)。我國(guó)目前的競(jìng)技體育競(jìng)賽中,使用興奮劑、弄虛作假、行賄受賄、故意傷害、假球黑哨等腐敗現(xiàn)象在全運(yùn)會(huì)、城運(yùn)會(huì)、職業(yè)聯(lián)賽、一些省市自治區(qū)運(yùn)動(dòng)會(huì)等重要賽場(chǎng)呈愈演愈烈日益蔓延發(fā)展之勢(shì),這嚴(yán)重危害我國(guó)競(jìng)技體育的正常發(fā)展。然而由于立法層面的不足和國(guó)內(nèi)學(xué)界尚乏對(duì)競(jìng)技體育犯罪的系統(tǒng)研究,致使在司法實(shí)踐中遭遇此類(lèi)問(wèn)題時(shí)無(wú)法可依,有法難依,執(zhí)法不嚴(yán),違法難究。本文通過(guò)對(duì)當(dāng)下競(jìng)技體育犯罪主要表現(xiàn)形式的梳理,抽象出競(jìng)技體育犯罪的行業(yè)特征和規(guī)律,進(jìn)而全面地分析我國(guó)競(jìng)技體育犯罪的嚴(yán)重社會(huì)危害性,以期警醒我國(guó)競(jìng)技體育從業(yè)者和司法行政機(jī)關(guān),加強(qiáng)打擊和預(yù)防競(jìng)技體育犯罪的力度,完善《體育法》及其配套的法律法規(guī),督促刑事立法,增強(qiáng)法律的威懾力,減少競(jìng)技體育犯罪行為,使我國(guó)競(jìng)技體育的生存發(fā)展有個(gè)健康有序的社會(huì)生態(tài)環(huán)境。
[Abstract]:Competitive sports is a sports activity with the main characteristic of competitive competition and the goal of creating excellent results. In the current competitive sports competitions in our country, corruption such as doping, fraud, bribery, intentional injury, false ball and black whistle have occurred in the National Games, the City Games, and the professional leagues. Some important sports venues, such as the sports meeting of provinces and autonomous regions, are increasingly spreading and developing, which seriously endangers the normal development of competitive sports in our country. However, due to the lack of legislation and the lack of systematic research on the crime of competitive sports in domestic academic circles, it is impossible to abide by such problems in the judicial practice, and it is difficult to abide by the law, to enforce the law lightly, and to investigate the violation of the law. By combing the main forms of the present competitive sports crime, this paper abstracts the industry characteristics and laws of the competitive sports crime, and then comprehensively analyzes the serious social harmfulness of the competitive sports crime in our country. With a view to alerting sports practitioners and judicial administrative organs in China, strengthening the fight against and preventing the crime of competitive sports, perfecting the Sports Law and its supporting laws and regulations, urging the criminal legislation, strengthening the deterrent power of the law, Reducing the criminal behavior of competitive sports makes the survival and development of competitive sports in our country have a healthy and orderly social ecological environment.
