【摘要】：黑社會(huì)(性質(zhì))組織犯罪又稱為有組織犯罪,是國(guó)際社會(huì)公認(rèn)的一種最高形態(tài)犯罪形式,已成為國(guó)際社會(huì)研究的重要課題之一。黑社會(huì)性質(zhì)組織罪是具有中國(guó)特色的獨(dú)立罪名,由于近十年黑社會(huì)性質(zhì)犯罪有愈演愈烈之勢(shì),對(duì)國(guó)家對(duì)社會(huì)乃至全球安全都有著不可估量的巨大危害,日益受到全球各個(gè)國(guó)家的強(qiáng)烈關(guān)注,當(dāng)然也已成為我國(guó)刑法理論界的熱點(diǎn),值得驕傲的是,在我國(guó)各界學(xué)者及實(shí)踐者的努力之下,已取得了階段性成果。但不可否認(rèn)的是,我國(guó)刑法學(xué)研究的通病——以注釋性研究方法即單一角度研究的視角缺陷也顯現(xiàn)于對(duì)黑社會(huì)組織犯罪的研究過(guò)程之中,研究視角開(kāi)闊,研究論點(diǎn)廣泛,研究方法多樣,但可惜的是研究成果卻往往難以運(yùn)用到具體的司法實(shí)踐之中,理論最終不能服務(wù)于實(shí)踐,甚為可惜。在此種情況之下,本論文作者從自身能力出發(fā),以犯罪學(xué)角度,結(jié)合刑法的相關(guān)理論來(lái)辨析黑社會(huì)性質(zhì)組織的相關(guān)概念,然后通過(guò)分析具體相關(guān)數(shù)據(jù)去研究我國(guó)黑社會(huì)性質(zhì)組織罪的基本特征,并總結(jié)我國(guó)黑社會(huì)性質(zhì)組織犯罪的生成原因,在總結(jié)成因基礎(chǔ)之上提出防治黑社會(huì)性質(zhì)組織犯罪生成在刑事實(shí)體法,未成年人保護(hù)等多方面的建議,希望能為黑社會(huì)性質(zhì)組織犯罪的制定、修改,解釋提供些許建議。
[Abstract]:Organized crime is also called organized crime, which is recognized by international society as one of the highest forms of crime, and has become one of the most important topics in international society research. The crime of underworld organization is an independent crime with Chinese characteristics. Because the crime of underworld nature has become more and more serious in the past decade, it has great harm to the country and even to the security of the world. More and more countries all over the world pay more and more attention to it, of course, it has become a hot spot in the criminal law circle of our country. It is proud that, with the efforts of scholars and practitioners from all walks of life in our country, we have achieved the stage results. But it can't be denied that the common problem of criminal law research in China is that the defect of angle of view in the study of criminal law from a single angle of view also appears in the research process of organized crime of the underworld, and the research perspective is broad and the research argument is extensive. The research methods are various, but unfortunately, the research results are often difficult to apply to the specific judicial practice, and the theory can not serve the practice, which is a pity. In this case, the author of this paper from its own ability, from the perspective of criminology, combined with the relevant theory of criminal law to analyze the related concepts of triad organizations, Then through the analysis of specific relevant data to study the basic characteristics of the organized crime of underworld nature in our country, and summarize the causes of the formation of the organized crime of the nature of the underworld in our country. On the basis of summing up the causes of formation, this paper puts forward some suggestions for preventing and controlling the organized crimes of underworld nature in criminal substantive law, protection of minors and so on, hoping to provide some suggestions for the formulation, modification and interpretation of organized crimes of underworld nature.
