【摘要】： 近年來,變態(tài)人格者故意殺人案件頻發(fā),造成了極其惡劣的社會影響,引起了社會各界廣泛的關(guān)注。變態(tài)人格者故意殺人案件與普通殺人案件有著巨大的差異,有必要對變態(tài)人格者故意殺人的相關(guān)問題進行深入細致的研究。通過對變態(tài)人格者故意殺人相關(guān)問題的研究,弄清變態(tài)人格者的心理過程、思維方式,總結(jié)變態(tài)人格者在故意殺人行為上的共性,找到隱藏在無序行為下的規(guī)律,在理論上可以豐富犯罪學(xué)的內(nèi)容,在實踐中可以提高此類案件的偵破效率,更有針對性的防控此類惡性案件的發(fā)生。本文分為五個部分。 第一部分是變態(tài)心理概述。介紹了變態(tài)心理的概念、分類。著重介紹了作為變態(tài)心理分支之一變態(tài)人格的概念和類型。通過對廣義變態(tài)心理和狹義變態(tài)心理的比較分析,筆者認為變態(tài)人格是指狹義變態(tài)心理中的人格障礙。 第二部分是變態(tài)人格者故意殺人犯罪的特征。首先,對變態(tài)人格者故意殺人犯罪的現(xiàn)狀及態(tài)勢作了分析。其次,對變態(tài)人格者故意殺人犯罪的特征進行論述,這也是本部分的重點。近年來,變態(tài)人格者故意殺人案件數(shù)量多,影響大。由于生存壓力大,導(dǎo)致很多人都存在不同程度上的心理障礙,因此,這類案件在現(xiàn)階段會一直存在,數(shù)量也可能會上升。變態(tài)人格者故意殺人犯罪的特征體現(xiàn)在整個犯罪過程中。犯罪預(yù)備階段的特征體現(xiàn)在犯罪動機,案發(fā)前的準備,案發(fā)前的心理狀態(tài),對被害人的物色這幾個方面。犯罪實行階段的特征體現(xiàn)在作案手段和作案的連續(xù)兩方面。犯罪既遂后的行為特征體現(xiàn)在尸體的棄置與處理及采取的后續(xù)行動這兩方面。 第三部分是變態(tài)人格罪犯的類型和人格特征。首先對不同類型的罪犯進行闡述,接著對變態(tài)人格罪犯的人格特征進行論述。根據(jù)命案呈現(xiàn)出的不同特征,可以將變態(tài)人格者罪犯分為有組織力罪犯和無組織力罪犯。兩者在犯罪的各個階段存在很大差異,但變態(tài)人格罪犯也不是絕對地分為有組織力與無組織力。有些罪犯混合了兩種罪犯的特征,并在有組織力與無組織力之間的程度上有所不同。變態(tài)人格罪犯主要的人格特征表現(xiàn)為愛幻想、偏激、高度自我主義及控制欲強。 第四部分是變態(tài)人格者故意殺人的原因。本部分對犯罪的原因進行了論述。變態(tài)人格者故意殺人的原因主要是兩方面:外在刺激和內(nèi)在需求。對變態(tài)人格者影響最大的外在因素主要是家庭中的問題、感情上的問題及工作中的問題。內(nèi)在原因則主要包括宣泄情緒、尋求滿足及證明自己三方面。變態(tài)人格者故意殺人動機的產(chǎn)生可能僅僅是內(nèi)在需求直接引發(fā)的,也可能是外在刺激與內(nèi)在需求的共同作用下誘發(fā)。但變態(tài)人格者本身才是犯罪的決定性因素,外在刺激只是誘因。 第五部分是變態(tài)人格者故意殺人的防控對策。本部分首先對變態(tài)人格的成因進行了分析,接著提出了防止變態(tài)人格形成的措施。其次,探討了在變態(tài)人格已經(jīng)形成后對犯罪的預(yù)防和控制。筆者認為,應(yīng)從兩個層次來對變態(tài)人格故意殺人進行防控。分析變態(tài)人格的成因,預(yù)防變態(tài)人格的形成,從根源上杜絕變態(tài)人格者故意殺人的發(fā)生。變態(tài)人格是在不同因素的綜合作用下形成的,歸納起來主要有生物、心理和環(huán)境三種因素。預(yù)防變態(tài)人格的形成,也應(yīng)根據(jù)這三方面的因素,提出針對性的措施,杜絕引發(fā)變態(tài)人格產(chǎn)生的條件。其次,在已經(jīng)形成變態(tài)人格后,對變態(tài)人格者故意殺人的防控。在變態(tài)人格已經(jīng)形成后,要想預(yù)防變態(tài)人格者故意殺人,就要對其及時的矯治,防止精神狀況進一步惡化。在變態(tài)人格者開始故意殺人后,司法機關(guān)就要自覺地串、并案,運用犯罪心理畫像技術(shù),盡早偵破案件,及時將罪犯抓捕歸案。
[Abstract]:In recent years, the cases of intentional homicide by abnormal personality persons have occurred frequently, which has caused extremely bad social influence and aroused widespread concern from all walks of life. There is a huge difference between the cases of intentional homicide by abnormal personality persons and the cases of ordinary homicide. It is necessary to make a thorough and detailed study on the related problems of intentional homicide by abnormal personality persons. The study of the related problems of the intentional homicide of the personality person, clarifying the psychological process and thinking mode of the abnormal personality person, summing up the commonness of the intentional homicide of the abnormal personality person, and finding the law hidden in the disorderly behavior, can enrich the content of criminology in theory, and can improve the efficiency and pertinence of the investigation of such cases in practice. To prevent and control such malignant cases, this article is divided into five parts.
The first part is an overview of abnormal psychology.The concept and classification of abnormal psychology are introduced.The concept and types of abnormal personality as one of the branches of abnormal psychology are emphatically introduced.Through the comparative analysis of generalized abnormal psychology and narrow abnormal psychology,the author thinks that abnormal personality refers to personality disorder in narrow abnormal psychology.
The second part is the characteristics of the crime of intentional homicide committed by the abnormal personality. Firstly, the present situation and situation of the crime of intentional homicide committed by the abnormal personality are analyzed. Secondly, the characteristics of the crime of intentional homicide committed by the abnormal personality are discussed, which is also the focus of this part. Pressure is so great that many people have different degrees of psychological barriers, so this kind of cases will always exist at this stage, the number may also rise. The characteristics of the crime of intentional homicide by the abnormal personality are reflected in the whole process of crime. The characteristics of the execution stage of a crime are embodied in the means of committing a crime and the continuity of committing a crime.
The third part is the types and personality characteristics of the criminal with abnormal personality.Firstly, the different types of criminals are expounded, and then the personality characteristics of the criminal with abnormal personality are discussed.According to the different characteristics of the homicide case, the criminal with abnormal personality can be divided into organized criminals and non-organized criminals. Some criminals mix the characteristics of the two types of criminals and differ in the degree of organizational power and non-organizational power. The main personality characteristics of the criminals with abnormal personality are fantasy, extreme, highly self-centered and controlling.
The fourth part is the reason for the intentional homicide of the abnormal personality person.This part discusses the reasons for the crime.The reasons for the intentional homicide of the abnormal personality person are mainly two aspects:external stimulation and internal demand.The external factors which have the greatest influence on the abnormal personality person are mainly the problems in family,emotional problems and work problems. The causes include three aspects: catharsis, seeking satisfaction and proving oneself. The motivation of intentional homicide of the abnormal personality person may only be caused by the internal demand directly, or by the joint effect of external stimulation and internal demand.
The fifth part is the prevention and control measures of the intentional homicide of the abnormal personality. This part first analyzes the causes of the abnormal personality, and then puts forward the measures to prevent the formation of the abnormal personality. To prevent and control, analyze the causes of abnormal personality, prevent the formation of abnormal personality, prevent the occurrence of intentional homicide of abnormal personality from the root. Abnormal personality is formed under the comprehensive effect of different factors, which can be summed up as biological, psychological and environmental factors. Preventing the formation of abnormal personality should also be based on these three factors. Secondly, after the abnormal personality has been formed, to prevent and control the intentional homicide of the abnormal personality. After the formation of the abnormal personality, in order to prevent the intentional homicide of the abnormal personality, it is necessary to correct the abnormal personality in time to prevent the further deterioration of the mental state. After the initial intentional homicide, the judicial organs should consciously collude and merge the cases, use the technology of criminal psychological portrait, detect the cases as soon as possible, and arrest the criminals in time.
