【摘要】： 受賄案件中犯罪嫌疑人多自恃清高,且有著職務優(yōu)越性、人際關系廣泛性。因此,在接受審訊時,他們大多數(shù)人對自己的犯罪事實會躲躲閃閃、避而不談、乃至拒供、謊供、翻供,使審訊工作一波三折,呈現(xiàn)復雜多變、僵持對峙的態(tài)勢。犯罪嫌疑人的行為是其內在心理因素的外在表現(xiàn)。因此,對犯罪嫌疑人應訊心理的研究對案件的突破有著至關重要的作用,同時也是審訊策略應用的依據(jù)所在。 目前,我國學者將犯罪嫌疑人的審訊過程大致分為對抗相持、動搖反復和供述交罪等三個階段,每個階段犯罪嫌疑人的應訊心理和應訊表現(xiàn)都不相同。對其進行深入分析便不難發(fā)現(xiàn),由于每個犯罪嫌疑人的個性心理不同,比如氣質、性格的差異等,導致了同一階段中不同類型犯罪嫌疑人的行為表現(xiàn)不盡相同。為了審訊策略運用的準確性,按照個性將犯罪嫌疑人分為狡詐型(理智型)、沖動型(情緒型)、頑固型(意志型)三類。針對各類型的犯罪嫌疑人采取有的放矢的審訊對策,可避免盲目性,對加速審訊工作的進程能夠起到一定促進作用。 本文結合刑法學、犯罪學及犯罪心理學的內容進行研究,首先從受賄案件中犯罪嫌疑人在不同階段中的應訊心理及行為表現(xiàn)入手,之后分析了狡詐型、沖動型及頑固型犯罪嫌疑人的不同表現(xiàn),然后深入分析了影響受賄案件中犯罪嫌疑人應訊心理的一些列內外因素,比如生理因素、心理因素、社會環(huán)境因素、情境因素、自然環(huán)境因素。最后,基于上述兩部分內容,提出審訊前應該做的準備工作,審訊過程中運用何種技巧才能起到最大作用,以及審訊人員應該注意的問題,在這一部分對狡詐型、沖動型和頑固型的犯罪嫌疑人又分別制定了不同的審訊策略。期待本文為我國公安、司法機關揭露及預防此類型的犯罪提供科學的依據(jù)和方法。
[Abstract]:In bribery cases, the suspects mostly rely on their superior position and extensive interpersonal relationship. Therefore, when being interrogated, most of them will evasive, avoid talking about their crimes, or even refuse to confess, lie and turn back confessions, make trial work twists and turns, present complex, changeable, deadlocked and confrontational situation. The behavior of criminal suspects is the external manifestation of their internal psychological factors. Therefore, the research of suspect's interrogation psychology plays an important role in the breakthrough of the case, and is also the basis for the application of interrogation strategy. At present, Chinese scholars divide the interrogation process of criminal suspects into three stages: confrontation, repeated shaking and confession, and the suspects' interrogation psychology and interrogation performance are different in each stage. It is not difficult to find that the behavior of different types of criminal suspects is different in the same stage because of the different personality psychology of each suspect, such as temperament, personality difference and so on. For the accuracy of interrogation strategy, the suspects were classified into three types according to their personality: cunning (rational), impulsive (emotional) and stubborn (willpower). It can avoid blindness and accelerate the process of interrogation by taking targeted interrogation countermeasures against various types of criminal suspects. Based on the contents of criminal law, criminology and criminal psychology, this paper begins with the psychological and behavioral behavior of criminal suspects in different stages of bribery cases, and then analyzes the cunning type. The different behaviors of impulsive and stubborn criminal suspects, and then deeply analyze some internal and external factors that affect the suspects' interrogation psychology in bribery cases, such as physiological factors, psychological factors, social environmental factors, situational factors, etc. Natural environment factors Finally, based on the above two parts, the preparation work should be done before the trial, what skills can be used in the interrogation process, and the problems that the interrogator should pay attention to, in this part of the cunning, Impulsive and stubborn suspects have developed different interrogation strategies. This article is expected to provide a scientific basis and method for the public security and judicial organs to expose and prevent this type of crime.
