【摘要】：隨著我國法治建設(shè)的不斷發(fā)展和進(jìn)步,我國的勞動教養(yǎng)制度已經(jīng)成為國內(nèi)外關(guān)注和爭議的焦點(diǎn)。法學(xué)界和實(shí)務(wù)部門的爭議和討論最為激烈,爭議內(nèi)容包括勞動教養(yǎng)制度的存廢、性質(zhì)、法律地位、對象、目的及實(shí)施程序等。根據(jù)我國現(xiàn)階段經(jīng)濟(jì)社會發(fā)展?fàn)顩r,勞動教養(yǎng)法律制度應(yīng)當(dāng)繼續(xù)存在,但必須從勞動教養(yǎng)對象、范圍、期限、名稱、管理、程序和執(zhí)行方式等方面進(jìn)行改革和完善。
[Abstract]:With the continuous development and progress of the construction of rule of law in China, the system of reeducation through labor has become the focus of attention and controversy at home and abroad. Legal circles and practical departments have the most heated disputes and discussions, including the retention and abolition of the system of re-education through labor, nature, legal status, object, purpose and implementation procedures, and so on. According to the present economic and social development of our country, the legal system of reeducation through labor should continue to exist, but it must be reformed and perfected from the aspects of the object, scope, time limit, name, management, procedure and execution mode of reeducation through labor.
