【摘要】： 高等院校是傳播先進(jìn)文化和從事科學(xué)研究的前沿陣地,是培養(yǎng)社會(huì)主義事業(yè)建設(shè)者和接班人的重要基地。改革開放30多年以來,在黨和國家的高度重視下,高校呈現(xiàn)出蓬勃發(fā)展的良好勢(shì)頭。然而,在高校發(fā)展浪潮高漲的同時(shí),一個(gè)難以根除的毒瘤——高校職務(wù)犯罪也歷經(jīng)了從無到有、并迅速膨脹的過程。而今,高校頻傳職務(wù)犯罪丑聞,一則則案例直叫人觸目驚心,人們心中圣潔的“象牙塔”形象已經(jīng)轟然倒地。高校職務(wù)犯罪防控已經(jīng)成為擺在國家、社會(huì)及高校自身面前的一個(gè)刻不容緩的問題。 對(duì)于任何一種犯罪現(xiàn)象,從其出現(xiàn)時(shí)我們的手足無措到能夠以成熟、完善的體系來加以防控,這中間必然是一個(gè)長期跋涉的過程。在這個(gè)過程中,如何破解高校運(yùn)行管理中遇到的難題,綜合運(yùn)用教育、行政、法律等手段有效預(yù)防違法違紀(jì)案件的發(fā)生,確保高等教育事業(yè)健康、可持續(xù)發(fā)展,是一個(gè)亟待解決的現(xiàn)實(shí)問題。 本文除導(dǎo)言和結(jié)語外,主體共分為四個(gè)部分。 第一章是高校職務(wù)犯罪防控概述。首先,該部分通過對(duì)職務(wù)犯罪的界定引出了高校職務(wù)犯罪的概念及高校職務(wù)犯罪防控的概念,指出高校職務(wù)犯罪防控是指具有高校職務(wù)犯罪防控職責(zé)的各主體為維護(hù)國家政權(quán)和高校教學(xué)秩序,通過整合國家、社會(huì)和高校的各項(xiàng)職能,規(guī)范和制約高校公職人員的職務(wù)行為,對(duì)高校職務(wù)犯罪所實(shí)施的系統(tǒng)性控制。此外,該部分還對(duì)高校職務(wù)犯罪的演化階段、高校職務(wù)犯罪的現(xiàn)狀及危害作了較為詳細(xì)的論述,從而指出通過體系構(gòu)建對(duì)高校職務(wù)犯罪進(jìn)行系統(tǒng)性防控是一個(gè)迫在眉睫的舉措。 第二章分析了高校職務(wù)犯罪發(fā)生的原因。任何事物的變化發(fā)展都是內(nèi)因和外因共同作用的結(jié)果。對(duì)高校職務(wù)犯罪主觀因素的分析,主要從錯(cuò)誤的價(jià)值觀念及變異的心理因素兩個(gè)方面進(jìn)行,指出灰暗消極的世界觀、自私自利的人生觀、隨心所欲的職業(yè)道德觀、淡薄虛無的法紀(jì)觀,以及吃虧補(bǔ)償心理、投資回報(bào)心理、法不責(zé)眾心理、僥幸逃脫心理是引發(fā)高校職務(wù)犯罪的主要主觀因素。接著闡述了高校職務(wù)犯罪發(fā)生的客觀原因,主要包括經(jīng)濟(jì)體制轉(zhuǎn)軌時(shí)期的消極影響、高校行政化機(jī)制的負(fù)面效應(yīng)、高校管理制度的缺陷、監(jiān)督措施的缺位及法紀(jì)教育的乏力等。對(duì)引發(fā)高校職務(wù)犯罪的原因所進(jìn)行的全面分析,是構(gòu)建高校職務(wù)犯罪防控體系的必要前提。 在對(duì)高校職務(wù)犯罪進(jìn)行了全面認(rèn)識(shí)、對(duì)高校職務(wù)犯罪原因進(jìn)行了深刻分析的基礎(chǔ)之上,第三章提出了高校職務(wù)犯罪防控體系的全面構(gòu)建。為了使讀者認(rèn)同高校職務(wù)犯罪防控具有堅(jiān)實(shí)的理論基礎(chǔ)及現(xiàn)實(shí)可行性,該部分首先闡述了高校職務(wù)犯罪具可控性的理論及現(xiàn)實(shí)基礎(chǔ)。接著,水到渠成地構(gòu)建了一個(gè)以“教育——管理——監(jiān)督”為主線的防控體系,其具體內(nèi)容包括:高校廉政文化建設(shè)、高校管理體制建設(shè)、高校管理制度建設(shè)、法律制度建設(shè)及高校監(jiān)督體制建設(shè)。
[Abstract]:Institutions of higher learning are the frontiers for spreading advanced culture and engaging in scientific research, and are the important bases for cultivating builders and successors of socialist undertakings.Since the reform and opening-up 30 years ago, with the great attention of the Party and the state, universities have shown a good momentum of vigorous development. Nowadays, there are many scandals of job-related crimes in Colleges and universities, one case is shocking, and the image of the Holy "ivory tower" in people's hearts has fallen to the ground. An urgent matter.
It is a long-term process for us to prevent and control any kind of criminal phenomena from being helpless when they appear to be able to use a mature and perfect system. In this process, how to solve the difficult problems encountered in the operation and management of colleges and universities, and how to effectively prevent violations of laws and discipline by means of education, administration and law, etc. It is a realistic problem to be solved urgently to ensure the healthy and sustainable development of higher education.
In addition to the introduction and conclusion, the main body is divided into four parts.
The first chapter is an overview of the prevention and control of job-related crimes in Colleges and universities.Firstly, this part introduces the concept of job-related crimes in Colleges and universities and the concept of prevention and control of job-related crimes in Colleges and universities through the definition of job-related crimes. In addition, this part also discusses in detail the evolution stage, the present situation and the harm of the university's duty crime, and points out that the university's duty crime can be controlled by the system construction. Systematic prevention and control of job-related crimes is an imminent move.
The second chapter analyzes the causes of job-related crimes in Colleges and universities.Everything changes and develops as a result of both internal and external factors.The analysis of subjective factors of job-related crimes in Colleges and universities is mainly carried out from two aspects of wrong values and psychological factors of variation.It points out that gloomy and negative world outlook and selfish outlook on life follow. The main subjective factors that lead to job-related crimes in Colleges and universities are the voluntary professional ethics, the weak and nihilistic concept of law, the psychology of compensation for losses, the psychology of return on investment, the psychology of not being responsible for the masses by law and the psychology of escaping by fluke. The negative effects of politicization mechanism, the defects of university management system, the absence of supervision measures and the lack of legal education, etc. A comprehensive analysis of the causes of University job-related crimes is a necessary prerequisite for the construction of the prevention and control system of University job-related crimes.
On the basis of a comprehensive understanding of job-related crimes in Colleges and universities and a profound analysis of the causes of job-related crimes in Colleges and universities, the third chapter puts forward a comprehensive construction of the prevention and control system of job-related crimes in Colleges and universities. Secondly, a preventive and control system with education-management-supervision as the main line has been constructed, which includes the construction of honest and clean government culture, management system, management system, law system and supervision system.
