【摘要】： 二戰(zhàn)以來,社區(qū)矯正作為一種社會(huì)化的新型刑罰執(zhí)行方式在西方資本主義國家蓬勃發(fā)展,并逐漸成為當(dāng)今世界刑罰執(zhí)行的主導(dǎo)方式。它的刑罰懲罰與社會(huì)矯治的雙重功能對(duì)促進(jìn)罪犯順利再社會(huì)化,預(yù)防再犯罪,從而推進(jìn)社會(huì)穩(wěn)定與和諧發(fā)展具有積極作用,是人類文明進(jìn)步的必然結(jié)果,也是社會(huì)人性化的必然產(chǎn)物。我國于2003年開始試點(diǎn)推行社區(qū)矯正制度,這意味著我國司法制度改革邁出了重要一步。幾年來,我國的社區(qū)矯正制度得到了一定的發(fā)展,同時(shí)也遇到了諸多問題與困難,對(duì)我國傳統(tǒng)行政管理模式提出了挑戰(zhàn)。本文以公共管理相關(guān)理論知識(shí)為基礎(chǔ),以國內(nèi)外社區(qū)矯正模式的經(jīng)驗(yàn)與教訓(xùn)為借鑒,分析了現(xiàn)階段制約我國社區(qū)矯正制度發(fā)展的不良因素,并進(jìn)而提出社區(qū)矯正主體多元化治理,完善立法體系,培養(yǎng)專門社區(qū)矯正工作者隊(duì)伍,建立完備的監(jiān)督評(píng)估體系等對(duì)策來解決我國社區(qū)矯正及其管理中面臨的問題,從而探求我國社區(qū)矯正制度發(fā)展之路。
[Abstract]:Since World War II, community correction, as a new socialized punishment execution method, has flourished in western capitalist countries, and has gradually become the leading way of penalty execution in the world. Its dual functions of penalty punishment and social correction play a positive role in promoting the smooth re-socialization of criminals, preventing re-crime, and thus promoting social stability and harmonious development, which is the inevitable result of the progress of human civilization. It is also the inevitable outcome of social humanization. Our country began to carry out community correction system in 2003, which means that the reform of our judicial system has taken an important step. In recent years, the community correction system of our country has got certain development, at the same time has encountered many problems and difficulties, has put forward the challenge to the traditional administration mode of our country. Based on the relevant theoretical knowledge of public management and the experience and lessons of the community correction model at home and abroad, this paper analyzes the negative factors that restrict the development of the community correction system in China at the present stage. And then put forward some countermeasures to solve the problems of community correction and its management in China, such as pluralistic governance of community correction subjects, perfection of legislative system, training of specialized community correction workers, establishment of a complete supervision and evaluation system, and so on. In order to explore the development of community correction system in China.
