【摘要】：20世紀50年代初期為了限制人口的自由流動,戶籍是糧食、工作機會、醫(yī)療、住房、養(yǎng)老等福利措施的分配依據。在城鄉(xiāng)二元結構的社會背景之下,不同類型和區(qū)域的戶籍所包含的勞動機會和福利措施存在較大差異,從而直接損害了公民的勞動權、社會保障權和受教育權。我國作為《經濟、社會及文化權利國際公約》和《兒童權利公約》的締約國,應當在立法上積極納入或轉化公約的禁止歧視原則,將戶籍歧視列為構成歧視的法定事由,建立戶籍歧視的民事法律責任制度,為公民提供民事救濟途徑,在法律層面明確政府內部的給付責任分擔機制,剝離戶籍的公共資源分配職能。
[Abstract]:In the early 1950s, in order to limit the free movement of the population, household registration was the basis for the distribution of welfare measures such as food, job opportunities, medical care, housing, old-age care, and so on. Under the social background of urban-rural dual structure, there are great differences in labor opportunities and welfare measures in different types and regions of household registration, which directly damages citizens' right to work, social security and education. As a State party to the International Covenant on Economic, Social and Cultural Rights and the Convention on the Rights of the Child, China should actively incorporate or transform the principle of prohibition of discrimination in the Convention on the Rights of the Child in its legislation, and include discrimination in the household registration as a statutory cause of discrimination. To establish the civil liability system of household registration discrimination, to provide civil remedies for citizens, to clarify the mechanism of sharing the responsibility for payment within the government at the legal level, and to divest the public resource distribution function of household registration.
