【摘要】： 經(jīng)濟(jì)全球化、全球信息化的快速發(fā)展,全球性經(jīng)濟(jì)危機(jī)的突襲,使得一些國家社會狀況發(fā)生急劇變化,有組織犯罪活動日益猖獗。有組織犯罪已經(jīng)不限于少數(shù)國家,在很多國家有組織犯罪都很嚴(yán)重,而且犯罪活動已經(jīng)不限于在一個國家之內(nèi),甚至于大量實(shí)施跨國有組織犯罪。這種情況對各國的國家安全、經(jīng)濟(jì)發(fā)展、法律秩序以及基本人權(quán)都構(gòu)成嚴(yán)重的威脅和挑戰(zhàn),引起世界各國、區(qū)域組織乃至國際組織的高度重視,有組織犯罪已經(jīng)成為全球關(guān)注的問題。新中國建立后的一段時間里基本消滅了有組織犯罪,但是20世紀(jì)70年代末以來,隨著經(jīng)濟(jì)體制改革和對外開放,有組織犯罪(黑社會性質(zhì)犯罪)死灰復(fù)燃,并且愈演愈烈,引起了黨和政府的高度重視,不斷進(jìn)行“打黑除惡”的專項斗爭。揭示中國近些年有組織犯罪產(chǎn)生的原因,總結(jié)有組織犯罪的犯罪學(xué)特征,并預(yù)測未來的發(fā)展趨勢,全球化背景下中國有組織犯罪在境外的活動規(guī)律和特點(diǎn)。在研究基礎(chǔ)上提出打擊有組織犯罪的對策,為我國有力打擊黑社會性質(zhì)犯罪,以及參與國際合作打擊跨國有組織犯罪提供理論支持。
[Abstract]:Economic globalization, the rapid development of global information technology, and the attack of global economic crisis make the social situation of some countries change dramatically, and organized crime activities become increasingly rampant. Organized crime is no longer limited to a few countries, and in many countries organized crime is serious, and criminal activities are no longer limited to one country, even a large number of transnational organized crime. This situation poses serious threats and challenges to the national security, economic development, legal order and fundamental human rights of all States and has drawn the highest attention of all States, regional and even international organizations, Organized crime has become a global concern. After the founding of New China, organized crime was basically eliminated for some time, but since the end of the 1970s, with the reform of the economic system and the opening up to the outside world, organized crime (triad crime) has resurfaced and intensified. Has aroused the party and the government's high attention, unceasing carries on "the fight against the criminal evil" the special struggle. This paper reveals the causes of organized crime in China in recent years, summarizes the criminological characteristics of organized crime, and predicts the future development trend, and the law and characteristics of organized crime activities outside China under the background of globalization. On the basis of the research, the countermeasures against organized crime are put forward in order to provide theoretical support for our country to crack down on the underworld crime and to participate in international cooperation to combat transnational organized crime.
