【摘要】： 偵查是偵查人員以逆向的方式去認(rèn)識(shí)案件的發(fā)生和發(fā)展,從結(jié)果到原因逐步查明案件的前因后果的過程。偵查邏輯是以刑事偵查科學(xué)的基本原理與普通邏輯原理的相互滲透、相互融合而產(chǎn)生的一門綜合性學(xué)科,它是研究偵查階段偵查人員的邏輯思維形式及其規(guī)律的實(shí)用邏輯。當(dāng)前對(duì)偵查邏輯的研究現(xiàn)狀來看,缺乏系統(tǒng)性和概括性,其中研究最多是偵查假設(shè),而對(duì)案件偵查過程中所覆蓋的其他邏輯問題并沒有作出具體和系統(tǒng)的研究。 為了凸顯偵查過程中邏輯運(yùn)用的重要作用及加強(qiáng)偵查邏輯理論研究的現(xiàn)實(shí)意義。本文致力于以偵查理論為背景,邏輯學(xué)為主線,從案件的推理、偵查假設(shè)和偵查訊問這三方面對(duì)偵查過程中邏輯的應(yīng)用進(jìn)行系統(tǒng)性研究。 本文共分為五章：第一章是導(dǎo)論,對(duì)本論題國(guó)內(nèi)外研究現(xiàn)狀、本研究的目的與意義進(jìn)行了概述；第二章介紹了偵查與偵查邏輯的基本理論,及偵查在訴訟中的地位；第三章是對(duì)偵查過程中所存在的主要推理形式進(jìn)行探討；第四章從偵查假設(shè)的提出、推演和驗(yàn)證的動(dòng)態(tài)角度入手,對(duì)其在偵查中的應(yīng)用作了分析；第五章是預(yù)設(shè)在偵查訊問中的應(yīng)用,其中對(duì)疑問句預(yù)設(shè)、虛假語(yǔ)用預(yù)設(shè)、復(fù)雜問語(yǔ)以及預(yù)設(shè)在訊問中的使用局限性進(jìn)行了闡述。
[Abstract]:Investigation is a process in which investigators understand the occurrence and development of cases in a reverse way and gradually find out the causes and consequences of cases from the results to the reasons. Investigation logic is a comprehensive subject which is produced by the mutual penetration and fusion of the basic principles of criminal investigation science and the common logic principles. It is a practical logic to study the logic thinking forms and their laws of investigators in the investigation stage. At present, there is a lack of systematicness and generality in the study of investigation logic, in which the most research is the investigation hypothesis, but there is no specific and systematic study on the other logic problems covered in the investigation process of a case. In order to highlight the important role of the application of logic in the process of investigation and the practical significance of strengthening the theoretical research of investigation logic. Based on the theory of investigation and logic as the main line, this paper makes a systematic study on the application of logic in the process of investigation from the three aspects of case reasoning, investigation hypothesis and investigation interrogation. This paper is divided into five chapters: the first chapter is the introduction, the domestic and foreign research status, the purpose and significance of this study are summarized, the second chapter introduces the basic theory of investigation and investigation logic, and the status of investigation in litigation; The third chapter discusses the main forms of reasoning in the process of investigation, the fourth chapter analyzes its application in the investigation from the point of view of the proposition of investigation hypothesis, the dynamic angle of deduction and verification. The fifth chapter is about the application of presupposition in interrogation, which expounds the presupposition of interrogative sentence, false pragmatic presupposition, complex interviewee and the limitation of presupposition in interrogation.
