公安報警臺功能轉(zhuǎn)變的路徑研究

【摘要】： 早期的110報警電話受理范圍較為狹窄,只處理有關(guān)的刑事案件和治安案件。在1996年福建省漳州公安局率先將把“110”提升成為報警服務(wù)臺,使110具備了快速處置警情和為人民群眾排憂解難的功能�！八挠兴谋亍奔础坝芯亟�、有難必幫、有險必救、有求必應(yīng)”,被公安部作為對110民警的硬性規(guī)定,并向全國承諾。與此同時,“四有四必”的承諾也使公安機關(guān)包攬了許多法定職責(zé)以外的既管不了也管不好的事情,使得本身就很緊張的警力資源更加捉襟見肘,而真正陷入危難的的報警群眾得不到及時救助,公安機關(guān)打擊犯罪、保護人民的職能難以得到履行。 有鑒于上述存在的亟須精簡的職能,針對近些年來“有限政府”方面的研究成果層出不窮,本文借鑒多方理論,研究了政府在職能有限化過程中,如何合理確定政府的職能范圍,并完善相關(guān)法律,加強行政法制建設(shè)的問題。由于西方政府職能是沿著“放任——全能——有限”這條線索進行逐步演變的,也就是由粗放、全面向精細、專業(yè)方面轉(zhuǎn)化。以美國警務(wù)制度改革為例,具體分析了“政治警務(wù)時期”、“警務(wù)進步時期”、“社區(qū)警務(wù)時期”等不同階段,進一步闡釋出了從傳統(tǒng)的“警察國家主義”的發(fā)展軌道步入“警察公民主義”的現(xiàn)代化道路的大方向,同時分析了我國政府在社會生活的眾多領(lǐng)域存在的職能過寬的問題,指出了改革開放以后,我國政府通過多次職能改革,但政府行政職能在行使過程中存在很多難以根除的痼疾,制約了社會主義經(jīng)濟的快速發(fā)展。 針對改變公安報警臺不合理的職能定位,由大見小,由簡到繁,借鑒使用洛克的有限政府理論,對建立一個有限有效的公安報警臺提出部分自己的觀點:在政治、經(jīng)濟、法治框架內(nèi),以實現(xiàn)內(nèi)部明確法律授權(quán),逐步實現(xiàn)依法行政,把不該屬于自己的權(quán)力還于社會,強化社會自治能力和進一步建立廣泛的監(jiān)察系統(tǒng)、提高群眾對公安報警臺的督察意識、重視輿論監(jiān)督對公安報警臺的規(guī)范作用、健全黨內(nèi)的監(jiān)督機制、完善公安信息化建設(shè)、穩(wěn)固發(fā)揮非政府組織的積極作用等方面的工作,實現(xiàn)公安內(nèi)部的權(quán)力配置、職能設(shè)定和規(guī)模設(shè)置上的有限化,對公安報警臺予以足夠放權(quán)并給予其足夠的自由裁量權(quán),方便其在公共管理領(lǐng)域施展身手,保一方平安,促進社會經(jīng)濟、民生的有益發(fā)展。在論述過程中,發(fā)掘出政府職能在內(nèi)部和外部所受到的影響,進而對“有限”與“有為”結(jié)合的途徑進行論述,協(xié)調(diào)“權(quán)力有限”和“有所作為”矛盾,是政府職能有限化過程中無法回避的主要矛盾,化解上述主要矛盾的方法就是兼顧雙方,通過政府內(nèi)部的有效協(xié)調(diào),實現(xiàn)二者的和諧一致,避免厚此薄彼,有所偏頗。在警察權(quán)力有限的理念下,社會治安管理理念要從過去強調(diào)“限制”、“防范”,向維護公民權(quán)利轉(zhuǎn)變,管理模式要從過去偏重“允許”性規(guī)定,向強調(diào)“禁止”性規(guī)定轉(zhuǎn)變,變管理至上為服務(wù)至上,由權(quán)威警察變?yōu)榉⻊?wù)型警察,由原來的控制者角色轉(zhuǎn)向服務(wù)者角色。從社會價值角度來看,有效促進了法律制度的進一步完善,社會范圍內(nèi)的個人或組織在一個成熟、完善的制度框架內(nèi)合理的追求自身的利益,并可通過此渠道表達自己的心聲,使各方面利益在法律允許的范圍內(nèi)相互得到妥協(xié),得以實現(xiàn)利益的最大化。由此可見,公安機關(guān)及其報警臺的職權(quán)一旦得到合理限制,將會更加有利于社會的長治久安,而對于解決非警務(wù)問題,除自身努力外,必須依托于政府強力主導(dǎo)、部門真正聯(lián)動以實現(xiàn)優(yōu)質(zhì)行政,由此已經(jīng)將公安報警臺功能變化上升到理論層次。 本文共分為三個部分,第一部分陳述了當(dāng)前公安報警臺的職能履行狀況,以及存在的問題。第二部分用政府職能有限化過程作為例證,論述了西方政府職能、我國政府職能變化的過程和美國警察警務(wù)制度改革的過程,并以洛克的理論作為主要的理論依據(jù)進行分析。第三部分論述了公安報警臺功能轉(zhuǎn)變的途徑,分別從前提條件、框架范圍、確立目標(biāo)三個層次予以分析,最終得出了公安報警臺功能得以理順的相應(yīng)途徑。
[Abstract]:The early 110 alarm telephone acceptance range is relatively narrow, only dealing with the relevant criminal cases and public order cases. In 1996, the Zhangzhou Public Security Bureau of Fujian province took the lead in raising "110" to the alarm service desk, which made 110 have the function of quick disposition of police situation and the function of solving difficulties for the people. "Four has four must" that is, "there is a police must be connected, there is no need." At the same time, the Ministry of public security has made a commitment to the 110 police and made a commitment to the whole country. At the same time, the promise of "four has four must" also made the public security organs cover many things outside the legal responsibility and do not manage and manage well. The alarming public can not get timely assistance, and the public security organs fight crime and protect the functions of the people.
In view of the urgent and streamlined functions of the above, the research achievements of the "limited government" have come out in an endless stream in recent years. In this paper, the author uses multi theory to study how to rationally determine the function range of the government, and improve the relevant laws and strengthen the construction of administrative legal system. The function is to evolve gradually along the clue of "laissez faire - omnipotent - Limited", which is from extensive, comprehensive to fine and professional. Taking the reform of the American police system as an example, it analyzes the different stages of "period of political policing", "period of policing progress", "period of community policing" and so on. From the development track of the traditional "police nationalism" into the big direction of the modernization road of "police citizenship", it also analyzes the problem that our government has a wide range of functions in many fields of social life, and points out that after the reform and opening up, our government has passed multiple functions reform, but the administrative function of the government has been exercised. There are many stubborn diseases which are difficult to eradicate in the process, which restricts the rapid development of the socialist economy.
In order to change the irrational position of the public security alarm table, from the small, from simple to complex, using Rock's limited government theory for reference, we put forward some own views on the establishment of a limited and effective public security alarm table: in the framework of political, economic, and rule of law, in order to realize the internal clear legal authority, and gradually realize the administration according to law, and should not belong to the law. Its own power is still in the society, strengthening the ability of social autonomy and further establishing a wide range of supervision system, raising the consciousness of the masses to supervise the police station, paying attention to the normative function of public opinion supervision, perfecting the supervision mechanism in the party, perfecting the information construction of public security, and giving full play to the positive role of the non-governmental organizations. The work, to realize the power allocation within the public security, the set of functions and the finalization of the scale, to the public security alarm station to be given enough power and to give them sufficient discretion, to facilitate their efforts in the field of public management, to ensure the safety of the one side, promote the social economy and the beneficial development of the people. In the process of discussion, excavated the government job. The internal and external influence, and then the way of combining "limited" and "promising", and coordinating the contradiction between "limited power" and "doing something", is the main contradiction that can not be avoided in the process of the government's function. This article is divided into three parts. The first part states the current situation of the function performance of the public security alarm station and the existing problems. The second part uses the process of the government function as an example, discusses the functions of the western government, the process of the change of the function of our government and the process of the reform of the police police system in the United States, and is made by Rock's theory. This paper analyzes the main theoretical basis. The third part discusses the ways of the function transformation of the public security alarm table, which are analyzed from the premise condition, the frame range and the target three levels. Finally, the corresponding ways to straighten out the functions of the public security alarm table are obtained.
