青少年網(wǎng)絡(luò)犯罪問(wèn)題研究

【摘要】： 隨著電腦的普及和網(wǎng)絡(luò)技術(shù)的飛速發(fā)展,人類進(jìn)入了一個(gè)嶄新時(shí)代——信息時(shí)代。在信息時(shí)代網(wǎng)絡(luò)造福人類的同時(shí),也給人們帶來(lái)一定的負(fù)面影響,特別是對(duì)青少年的沖擊更大,網(wǎng)絡(luò)改變了他們的生活方式、價(jià)值取向及性格愛(ài)好,更使得部分青少年心理變得異常扭曲、道德淪喪,進(jìn)行網(wǎng)絡(luò)盜竊、網(wǎng)上詐騙,甚至由網(wǎng)絡(luò)引發(fā)的暴力型犯罪。本文從研究青少年網(wǎng)絡(luò)犯罪的定義入手,由淺入深、由表及里的歸納了我國(guó)青少年網(wǎng)絡(luò)犯罪的現(xiàn)狀、特征、主要分類等,并從導(dǎo)致青少年網(wǎng)絡(luò)犯罪的原因?yàn)榍腥肟?提出了多管齊下、綜合治理的對(duì)策。本文近4萬(wàn)字,為四大部分。 緒論分析了網(wǎng)絡(luò)犯罪、青少年犯罪及青少年網(wǎng)絡(luò)犯罪的定義,闡述了研究青少年網(wǎng)絡(luò)犯罪的背景和意義。 第一部分青少年網(wǎng)絡(luò)犯罪現(xiàn)象。首先從犯罪主體、犯罪客體及犯罪形式三方面闡述了青少年網(wǎng)絡(luò)犯罪的特征。接著對(duì)青少年網(wǎng)絡(luò)犯罪作以大略分類。最后從六個(gè)層面,論述青少年網(wǎng)絡(luò)犯罪的發(fā)展趨勢(shì)。 第二部分青少年網(wǎng)絡(luò)犯罪的原因。其一是宏觀分析。從政治、經(jīng)濟(jì)、文化及社會(huì)因素入手,分析了網(wǎng)絡(luò)對(duì)青少年負(fù)面作用的原因。其二是微觀分析。針對(duì)家庭、學(xué)校、青少年個(gè)體以及網(wǎng)絡(luò)本身的原因,從個(gè)人或群體入手、通過(guò)觀察人們的社會(huì)交往從而找出導(dǎo)致青少年網(wǎng)絡(luò)犯罪的微觀原因。 第三部分治理青少年網(wǎng)絡(luò)犯罪的對(duì)策。這一部分是本文的重點(diǎn),青少年網(wǎng)絡(luò)犯罪是一個(gè)嚴(yán)重的社會(huì)性問(wèn)題,要社會(huì)各方面的共同努力,進(jìn)行綜合治理。首先,社會(huì)是治理青少年網(wǎng)絡(luò)犯罪的堅(jiān)實(shí)基礎(chǔ)。其次,學(xué)校是治理青少年網(wǎng)絡(luò)犯罪的關(guān)鍵環(huán)節(jié)。第三,家庭是治理青少年網(wǎng)絡(luò)犯罪的重點(diǎn)部位。第四,也是重中之中,從刑事實(shí)體立法、刑事訴訟程序立法的角度,加強(qiáng)對(duì)青少年網(wǎng)絡(luò)犯罪的有效治理。最后,就是青少年必須從自身從發(fā),加強(qiáng)文化、法律、道德等方面的強(qiáng)化,從而達(dá)到從根本上治理其網(wǎng)絡(luò)犯罪的目的。
[Abstract]:With the popularization of computer and the rapid development of network technology, mankind has entered a new era-the information age. In the information age, while the Internet benefits mankind, it also brings some negative effects to people, especially the impact on teenagers. The Internet has changed their way of life, value orientation and personality and hobbies. It also makes some teenagers become extremely distorted, moral decay, network theft, online fraud, and even violent crimes triggered by the network. Starting with the study of the definition of juvenile cybercrime, this paper sums up the present situation, characteristics, main classification of juvenile cybercrime in our country from simple to deep, from the surface to the inside, and from the reasons leading to the juvenile cybercrime is the entrance. This paper puts forward the countermeasures of multi-pronged and comprehensive management. This article nearly 40, 000 words, for four parts. The introduction analyzes the definitions of cybercrime, juvenile delinquency and juvenile cybercrime, and expounds the background and significance of the study of juvenile cyber crime. The first part is the phenomenon of juvenile cyber crime. Firstly, the characteristics of juvenile cyber crime are expounded from three aspects: subject, object and form of crime. Then the juvenile network crime to make a general classification. Finally, from six levels, discusses the development trend of juvenile cyber crime. The second part is the reason of juvenile cyber crime. One is macro analysis. This paper analyzes the negative effects of internet on teenagers from the aspects of politics, economy, culture and society. The second is microanalysis. In view of the reasons of family, school, youth individual and network itself, starting from individuals or groups, we can find out the microcosmic causes of juvenile cyber crime by observing people's social interaction. The third part deals with the countermeasures of juvenile cyber crime. This part is the focus of this paper, juvenile cybercrime is a serious social problem, we should make joint efforts of all aspects of society, comprehensive management. Above all, society is the solid foundation that manages juvenile network crime. Secondly, the school is the key link in the management of juvenile cyber crime. Third, the family is the key part of the management of juvenile cyber crime. Fourth, it is also in the heavy, from the criminal entity legislation, the criminal procedure legislation angle, strengthens to the juvenile network crime the effective management. Finally, teenagers must strengthen their culture, law, morality and so on from their own development, so as to achieve the goal of fundamentally governing their cybercrime.
