浙江省溫州市2005年-2009年鄉(xiāng)科級以上職務(wù)犯罪情況的調(diào)查報告

【摘要】：國家工作人員在履行自身職務(wù)所賦予的權(quán)力、職責(zé)時,能否遵守國家法律,保持自身廉潔情操,關(guān)系到社會經(jīng)濟(jì)能否良好發(fā)展,國家政權(quán)能否穩(wěn)固。近年來,隨著我國社會領(lǐng)域的深刻變革,職務(wù)犯罪作為違反職務(wù)廉潔性最為嚴(yán)重的表現(xiàn)形式,其在我國依然呈高發(fā)態(tài)勢,形勢嚴(yán)峻,職務(wù)犯罪涉及的金額越來越大、級別越來越高、層面越來越廣,業(yè)已成為阻礙我國現(xiàn)代化進(jìn)程的一個重要因素。對職務(wù)犯罪的現(xiàn)狀進(jìn)行調(diào)查,深入分析當(dāng)前職務(wù)犯罪的特點、原因和規(guī)律,并在此基礎(chǔ)上提出有針對性的對策,無疑具有重要的理論意義和實踐價值。 本文主要采用訪談法和案卷調(diào)查法展開調(diào)查,對中共溫州市紀(jì)律檢查委員會、溫州市監(jiān)察局2005-2009年查辦的職務(wù)犯罪案件為對象,進(jìn)行整理分析,在此基礎(chǔ)上提出預(yù)防職務(wù)犯罪的建議和對策,希望對防治職務(wù)犯罪有參考價值。 本調(diào)查報告包括五部分,共三萬字。 第一部分簡要說明本調(diào)查的目的和意義,即通過對中共溫州市紀(jì)律檢查委員會、溫州市監(jiān)察局2005-2009年查辦的職務(wù)犯罪案件情況的分析,探究該區(qū)職務(wù)犯罪的原因、特點,提出預(yù)防的建議和對策。 第二部分介紹了完成本調(diào)查報告所用的調(diào)查方法,即訪談法和案卷調(diào)查法；同時闡明有關(guān)概念,即本文所指鄉(xiāng)科級以上國家工作人員、職務(wù)犯罪的內(nèi)涵和外延。 第三部分是對此次調(diào)查結(jié)果的闡述。首先對近五年溫州市鄉(xiāng)科級以上干部職務(wù)犯罪形勢做出總體判斷,即職務(wù)犯罪案件數(shù)量總體呈現(xiàn)上升趨勢。其次分析了溫州市鄉(xiāng)科級以上干部職務(wù)犯罪主要特點：在犯罪種類方面,主要表現(xiàn)為貪污賄賂犯罪和瀆職犯罪；在犯罪主體方面,一是年齡特征趨于模糊,各個年齡階段均有發(fā)案,二是受教育程度有上升趨勢,�？坪痛髮W(xué)本科學(xué)歷人員所占比重較大,三是在犯罪主體的相互關(guān)聯(lián)性方面,群體性的職務(wù)犯罪現(xiàn)象增多,串案窩案涉案人數(shù)和所占比例上升趨勢明顯,四是犯罪主體通過各種手段逃避調(diào)查；在犯罪手段方面,一是財物獲取的方式更加趨于隱蔽,二是“權(quán)權(quán)”交易增多,往往通過制度層面操作；同時,網(wǎng)絡(luò)監(jiān)督的作用日益顯現(xiàn)。 第四部分是對調(diào)查結(jié)果的分析,探討了導(dǎo)致職務(wù)犯罪的原因。其中,犯罪主體方面原因包括理想信念缺失、法治理念缺失、職業(yè)道德缺失、心理失衡；制度方面原因包括預(yù)防監(jiān)督制度、激勵制度、懲罰制度等方面的缺陷；社會方面原因包括溫州地域文化、社會風(fēng)氣中消極因素的影響；同時,還有查辦懲處方面的原因。以上問題的綜合作用,造成了職務(wù)犯罪高發(fā)的嚴(yán)峻形勢。 第五部分是在分析職務(wù)犯罪原因的基礎(chǔ)上,提出預(yù)防職務(wù)犯罪的對策和建議,主要包括加強宣傳教育,完善預(yù)防監(jiān)督、激勵和懲罰制度等,發(fā)揮刑罰在打擊和懲治方面的警示作用,弘揚廉潔文化、凈化社會風(fēng)氣等方法。 加強職務(wù)犯罪懲治和預(yù)防工作,是一項長期而艱巨的任務(wù)。對此,需要社會各階層共同努力,充分發(fā)揮所有可調(diào)動的積極因素,消除消極影響,及時預(yù)見并解決各種矛盾,堅持標(biāo)本兼治的原則,綜合治理、懲防結(jié)合,才‘能達(dá)到預(yù)防和減少職務(wù)犯罪的目的。

Secondly, the main characteristics of the duty crime of the cadres above the township level in Wenzhou are analyzed: the main manifestations of the crime are the corruption. The comprehensive role of the above problems has caused the severe situation of the high incidence of the duty crime.
The fifth part, based on the analysis of the reasons for the duty crime, puts forward the countermeasures and suggestions for the prevention of duty crime, including strengthening the propaganda and education, perfecting the prevention and supervision, the incentive and punishment system and so on, giving full play to the warning role of the penalty in the field of punishing and punishing, carrying forward the clean culture and purifying the social atmosphere.
