【摘要】：司法實(shí)踐中,由瑕疵出資引發(fā)的瑕疵股權(quán)轉(zhuǎn)讓問(wèn)題較為常見(jiàn),相應(yīng)瑕疵出資責(zé)任的承擔(dān)問(wèn)題引起糾紛不斷,本文在對(duì)浙江某公司瑕疵出資股權(quán)轉(zhuǎn)讓司法會(huì)計(jì)鑒定案例解析的基礎(chǔ)上,分析了相關(guān)的司法會(huì)計(jì)鑒定及股權(quán)轉(zhuǎn)讓的責(zé)任承擔(dān)問(wèn)題。
[Abstract]:In judicial practice, the problem of the transfer of defective shares caused by defective capital contribution is common, and the corresponding problem of bearing the responsibility of defective capital contribution causes disputes. On the basis of the analysis of the case of judicial accounting for the transfer of defective capital shares in a company in Zhejiang Province, this paper analyzes the related problems of judicial accounting identification and the responsibility of equity transfer.
