【摘要】：職務(wù)犯罪行為人利用職權(quán)謀取私利具有經(jīng)濟(jì)學(xué)理性特征。因此,其行為必然遵從經(jīng)濟(jì)學(xué)的基本法則。然而,職務(wù)犯罪行為從本質(zhì)上講是非理性的,理性與非理性來自于同一個(gè)行為主體正是經(jīng)濟(jì)人的"二象性"特征。無論職務(wù)犯罪的行為策略如何理性,由于它本質(zhì)上是非理性的違法行為,終究難逃法律的制裁。大量案例還印證了權(quán)力的執(zhí)掌者作為人而不是工具存在于權(quán)力場,職務(wù)犯罪行為完全是一種自甘墮落的選擇。因此,防范職務(wù)犯罪的對(duì)策選擇應(yīng)該把理性分析作為基本的出發(fā)點(diǎn)和前提之一。經(jīng)濟(jì)學(xué)理性視角的對(duì)策選擇,應(yīng)該是提高犯罪成本、加大犯罪風(fēng)險(xiǎn)、減少犯罪收益,以遏制犯罪動(dòng)機(jī),切斷犯罪動(dòng)機(jī)與機(jī)會(huì)之間的聯(lián)系。
[Abstract]:It is a rational feature of economics that the doer of duty crime takes advantage of his power to seek personal gain. Therefore, its behavior must conform to the basic law of economics. However, the crime of duty is irrational in nature, and rationality and irrationality come from the duality of economic man. No matter how rational the behavior strategy of duty crime is, it is impossible to escape the sanction of law because of its irrational illegal behavior. A large number of cases also confirmed that the leader of power exists in the field of power as a person rather than a tool, and that the crime of duty is a completely corrupt choice. Therefore, rational analysis should be regarded as one of the basic starting points and premises. From the angle of economic rationality, the countermeasures should be to increase the cost of crime, increase the risk of crime and reduce the proceeds of crime in order to contain the motive of crime and cut off the relation between the motive of crime and the opportunity.
