【摘要】：近年來,公安民警正當執(zhí)法過程中遭受不法侵害的事件日益頻繁,民警被謾罵、圍攻、惡意投訴和暴力襲擊的事件不斷在各地頻繁發(fā)生,基層民警反應(yīng)強烈,引起了社會各界的關(guān)注。公安民警是法律的捍衛(wèi)者,是人民群眾生命財產(chǎn)安全的保護者,由于其工作的特殊性,他們的執(zhí)法權(quán)益特別容易受到侵害。但作為公民,民警的權(quán)益也同樣需要法律的保護,這既是社會道義,也是法律的責任。目前我國在維護和保障民警正當執(zhí)法權(quán)益方面還存在一定的不足,造成很多侵害民警執(zhí)法權(quán)益的行為沒有得到應(yīng)有的懲罰,嚴重的傷害了民警的身體和心理,’極大的挫傷了民警的工作積極性。 雖然《人民警察法》在警務(wù)保障上賦予公安民警許多職權(quán),不僅可以對不法行為人采取各種強制措施,而且在緊急情況下可使用警具、警械和武器、,當遇到暴力抗法襲警時,《刑法》也有相關(guān)的懲罰規(guī)定,可是這些法律的可操作性不強,需要細化。、譬如犯罪進行到哪個階段可以開槍?再如《治安管理處罰條例》中對醉酒的人違反治安管理的規(guī)定：醉酒的人在醉酒的狀態(tài)中對本人有危險或者對他人的安全有威脅的,應(yīng)當將其約束到酒醒�？墒侨绾渭s束?法律上沒有細則來規(guī)定。所以常常出現(xiàn)民警有槍不敢用,對醉酒之人不敢上手去管的現(xiàn)象。由于現(xiàn)行法律制度存在諸多問題,使得公安民警維權(quán)無法可依,嚴重影響了民警維權(quán)工作的開展。筆者從侵害民警執(zhí)法權(quán)益行為的特點入手,分析民警執(zhí)法權(quán)益屢受侵害的原因以及我國在維護和保障民警執(zhí)法權(quán)益方面采取的措施以及存在的不足,從而尋求民警執(zhí)法權(quán)益的途徑和機制,改善民警的執(zhí)法環(huán)境,提高警察的執(zhí)法水平和自我保護能力,維護民警的執(zhí)法權(quán)益。

At present, there are still some deficiencies in safeguarding and safeguarding the legitimate rights and interests of the police in our country, resulting in a lot of violations of the rights and interests of the police not being punished properly and seriously harming the body and psychology of the police. The police's enthusiasm was greatly dampened. Although the people's Police Law confers many powers and powers on police security, it can not only take all kinds of coercive measures against the wrongdoers, but also use police equipment in emergency situations. Police equipment and weapons, when faced with violence against the law attack the police, the Criminal Law also has relevant punishment provisions, but these laws are not strong operability, need to be refined. For example, when the crime can be fired at which stage? As in the regulations on Administrative penalties for Public Security, a drunken person who violates the provisions of public security administration: a drunken person who is dangerous to himself or a threat to the safety of others in a drunken state shall be confined to a drunken state. But how? There are no rules in the law. So often the police have guns dare not use, drunken people do not dare to control the phenomenon. There are many problems in the current legal system, which makes it impossible for the police to protect their rights, which seriously affects the development of the work of protecting the rights of the police. The author begins with the characteristics of infringing upon the law enforcement rights and interests of the police, analyzes the reasons why the law enforcement rights and interests of the police are frequently infringed, and the measures taken and the shortcomings of our country in maintaining and protecting the law enforcement rights and interests of the police. In order to find the way and mechanism of the law enforcement rights and interests of the police, improve the law enforcement environment of the police, improve the law enforcement level and self-protection ability of the police, safeguard the law enforcement rights and interests of the police.
