【摘要】： 我國的勞動教養(yǎng)制度已經(jīng)走過了近五十年的風雨歷程,它成功地教育、挽救了大量違法和輕微犯罪人員,為維護國家政治穩(wěn)定和社會安寧,做出了巨大的貢獻。但是,無論在立法方面還是在執(zhí)行方面,勞動教養(yǎng)制度與建設社會主義法制國家的總體要求都存在著諸多不適應的地方,如:對收容對象的界定呈擴大化趨勢;其地域限制也違背了社會主義法律適用的平等原則和法制統(tǒng)一原則;其審批程序又缺乏公開性,并未納入司法程序,而這直接關系到公民人權的切實保障;在勞動教養(yǎng)的執(zhí)行上“二勞改”的痕跡比較嚴重,勞動教養(yǎng)的特色不夠明顯等等。勞教制度面臨著質(zhì)疑和挑戰(zhàn),迫切需要改革,近年來學者們及國際社會對勞教制度的批判使勞教的改革愈發(fā)緊迫。本文系統(tǒng)地介紹了勞教制度的歷史發(fā)展歷程,歸納整理出各個時期的特征,探究了勞教制度存在的問題及其成因。隨著我國法治建設的不斷發(fā)展,勞教制度的合法性、合理性和正當性倍受質(zhì)疑,并日益成為國際人權斗爭的焦點和輿論關注的熱點。為此,筆者對理論界關于勞教制度的出路進行了評析,并研究了西方的保安處分制度和輕罪制度,將其與我國的勞教制度進行比較研究,提出應借鑒國外的輕罪制度,并結合中國的實際情況,對勞教制度進行改革,將其輕罪化,納入刑罰體系。筆者希望通過對西方輕罪制度的對比,能對我國的勞動教養(yǎng)制度的改革提供可借鑒的可行性方案,使勞教制度盡快步入法治軌道,使我國的法制建設更加健全完善。
[Abstract]:Our country's reeducation through labor system has gone through nearly 50 years of wind and rain course, it successfully educates, has saved a large number of illegal and minor criminal personnel, has made the huge contribution to maintain the national political stability and the social tranquillity. However, in the aspect of legislation and implementation, there are many unsuitable places in the system of re-education through labor and the overall requirement of building a socialist legal country, such as: the definition of the object of reception is enlarged; Its territorial limitation also violates the principle of equality and the unification of legal system in the application of socialist laws, and its examination and approval procedure lacks openness and is not included in the judicial procedure, which is directly related to the practical protection of citizens' human rights. In the implementation of re-education through labor, the marks of labor reform are serious, the characteristics of labor education are not obvious enough and so on. The reform of reeducation through labour system is facing challenge and challenge, and it needs to be reformed urgently. In recent years, scholars and the international community have criticized the system of re-education through labor, which makes the reform of re-education through labour more urgent. This paper systematically introduces the historical development of the system of re-education through labor, summarizes the characteristics of each period, and probes into the problems and causes of the system of re-education through labour. With the development of the construction of rule of law in China, the legitimacy, rationality and legitimacy of the system of re-education through labour have been questioned and become the focus of international human rights struggle and the focus of public opinion. Therefore, the author comments on the way out of the reeducation through labour system in the theoretical circle, studies the security punishment system and the misdemeanor system in the west, compares them with the reeducation through labour system in our country, and puts forward that the misdemeanor system of foreign countries should be used for reference. Combined with the actual situation in China, the reform of the re-education through labour system, its misdemeanor, into the penal system. The author hopes that through the comparison of the western misdemeanor system, it can provide the feasible scheme for the reform of the reeducation through labor system in our country, make the reeducation through labor system step into the track of the rule of law as soon as possible, and make the legal system construction of our country more perfect and perfect.
