【摘要】：正國(guó)家數(shù)據(jù)主權(quán)安全不同于傳統(tǒng)的領(lǐng)土、領(lǐng)海、領(lǐng)空主權(quán)所指向的傳統(tǒng)安全,數(shù)據(jù)主權(quán)指向的是非傳統(tǒng)安全,其特殊之處在于沒有物理空間邊界,在數(shù)字社會(huì)中所涉及的諸多領(lǐng)域無(wú)一不需要數(shù)據(jù)支撐與表達(dá),這些領(lǐng)域的安全業(yè)已被總體國(guó)家安全觀所統(tǒng)攝。因而,有必要從主權(quán)高度構(gòu)建一套能夠保護(hù)總體國(guó)家安全的規(guī)則制度體系,即構(gòu)建"總體國(guó)家安全觀下的國(guó)家數(shù)據(jù)主權(quán)"。在復(fù)雜的國(guó)際形勢(shì)下,隨著"數(shù)據(jù)驅(qū)動(dòng)發(fā)展"
[Abstract]:The security of data sovereignty of a country is different from that of traditional territory, the traditional security directed by sovereignty over territorial sea and airspace, the non-traditional security directed by data sovereignty, and the fact that there is no physical space boundary. In the digital society, all the fields involved need data support and expression, and the security in these fields has been controlled by the overall concept of national security.
