【摘要】：社區(qū)矯正誕生于20世紀(jì)60、70年代,是在刑罰制度改革進(jìn)程中衍生而來(lái)的一種全新的刑罰執(zhí)行方式,如今已成為全球非監(jiān)禁刑罰發(fā)展的趨勢(shì)與潮流,對(duì)于促使罪犯順利回歸社會(huì),預(yù)防和減少重新違法犯罪,進(jìn)而實(shí)現(xiàn)社會(huì)和諧穩(wěn)定發(fā)展具有積極作用,是人類文明進(jìn)步的必然結(jié)果,也是保障人權(quán),實(shí)現(xiàn)行刑社會(huì)化的必然產(chǎn)物。相較于西方國(guó)家長(zhǎng)達(dá)幾十年甚至上百年的社區(qū)矯正歷史而言,我國(guó)的社區(qū)矯正仍處于探索階段,尤其是泉州市鯉城區(qū)的社區(qū)矯正工作,出現(xiàn)一些困難和難題,亟待得到解決和完善。本文通過(guò)文獻(xiàn)研究法、比較研究法等研究方法,對(duì)完善泉州市鯉城區(qū)社區(qū)矯正工作進(jìn)行了研究和思考。首先對(duì)論文的背景、意義與概念予以闡述,其次,分析泉州市鯉城區(qū)社區(qū)矯正工作開(kāi)展情況,指出該區(qū)目前存在部門配合力度不高、缺乏穩(wěn)定且專業(yè)化的社區(qū)矯正工作隊(duì)伍、懲處措施無(wú)法對(duì)矯正人員形成威懾力以及矯正主體較為單一等四個(gè)問(wèn)題,并對(duì)造成問(wèn)題的原因予以剖析。然后,參考借鑒國(guó)內(nèi)外社區(qū)矯正試點(diǎn)地區(qū)的實(shí)踐經(jīng)驗(yàn),結(jié)合新公共服務(wù)理論和治理理論,指出在公共管理視角下完善鯉城區(qū)社區(qū)矯正工作要通過(guò)加強(qiáng)各部門對(duì)社區(qū)矯正的重視程度、建立穩(wěn)定且高素質(zhì)的社區(qū)矯正工作隊(duì)伍、強(qiáng)化社區(qū)矯正懲處威懾力以及建立矯正主體多元化的治理關(guān)系等措施,以此促進(jìn)該區(qū)社會(huì)管理創(chuàng)新和社區(qū)矯正工作的健康發(fā)展,最大限度減少重新違法犯罪,營(yíng)造良好的社會(huì)發(fā)展環(huán)境。
[Abstract]:Community correction, born in the 1960s and 1970s, is a new way of penalty execution derived from the reform of the penal system. Now, it has become the trend and trend of the development of non-custodial punishment in the world, which can promote the smooth return of criminals to society. It is the inevitable result of the progress of human civilization to prevent and reduce the illegal crime and realize the harmonious and stable development of the society. It is also the inevitable product of protecting human rights and realizing the socialization of execution. Compared with the history of community correction in western countries for decades or even hundreds of years, the community correction in our country is still in the exploratory stage, especially in the community correction work in the leicheng district of Quanzhou City, there are some difficulties and difficulties. Urgent need to be solved and improved. Based on the methods of literature research and comparative study, this paper studies and ponders the improvement of community correction in leicheng district of Quanzhou city. Firstly, the background, significance and concept of the paper are expounded. Secondly, the author analyzes the development of community correction in leicheng District of Quanzhou City, and points out that there is not enough cooperation between the departments in this area at present, and there is a lack of stable and professional community correction work force. The punishment measures can not deter the correction personnel and the correction subject is relatively single, and the causes of the problems are analyzed. Then, referring to the practical experience of the pilot areas of community correction at home and abroad, combining with the new public service theory and governance theory, It is pointed out that it is necessary to establish a stable and high quality community correction team by strengthening the attention of various departments to community correction in the view of public management. To strengthen the deterrent force of community correction punishment and to establish a pluralistic governance relationship of correction subjects, so as to promote the innovation of social management and the healthy development of community correction work in this area, and to minimize the re-offending of crimes. Create a good environment for social development.
