【摘要】：改革開放以來,中國堅(jiān)持把發(fā)展作為第一要?jiǎng)?wù),把經(jīng)濟(jì)建設(shè)作為中心任務(wù),現(xiàn)已然成為世界經(jīng)濟(jì)強(qiáng)國之一,人民生活總體上達(dá)到小康水平。但是隨著社會(huì)轉(zhuǎn)型加劇、社會(huì)階層分化,導(dǎo)致社會(huì)資源分配愈發(fā)不均衡,社會(huì)貧富差距不斷擴(kuò)大,建設(shè)和諧社會(huì)面臨嚴(yán)峻考驗(yàn)。近年來,類似公交縱火犯罪的個(gè)人極端暴力活動(dòng)頻發(fā),嚴(yán)重威脅社會(huì)穩(wěn)定。本文以犯罪情境預(yù)防理論為視角,著重解讀公交縱火犯罪情境因素,構(gòu)建情境預(yù)防體系,改造有利公交縱火犯罪發(fā)生的具體情境,以期加大公交縱火行為的風(fēng)險(xiǎn)和難度,消除犯罪機(jī)會(huì)和條件。全文可分四部分。第一部分研究的主要內(nèi)容為:我國公交縱火犯罪現(xiàn)狀及成因。首先,將近年來此類案件進(jìn)行綜合分析,對(duì)其特點(diǎn)、成因進(jìn)行總結(jié),從而概括出現(xiàn)狀。其次,描述公交縱火犯罪的現(xiàn)有對(duì)策,并對(duì)所存在的問題進(jìn)行解讀。第二部分研究的主要內(nèi)容為:公交縱火犯罪情境預(yù)防的前景分析。首先,介紹情境預(yù)防的理論背景,切入理論的發(fā)展歷史,簡要探索情境預(yù)防理論,包括其預(yù)防策略和既有挑戰(zhàn)。其次,結(jié)合現(xiàn)實(shí)展示情境預(yù)防的爭(zhēng)議和前景。第三部分研究的主要內(nèi)容為:研究情境預(yù)防導(dǎo)入公交縱火犯罪預(yù)防中的積極意義。首先,總結(jié)情境預(yù)防與司法預(yù)防、社會(huì)預(yù)防的不同之處,強(qiáng)調(diào)情境預(yù)防理論的優(yōu)勢(shì),著重展開情境預(yù)防導(dǎo)入公交縱火犯罪的必要性。其次,論證公交縱火犯罪情境預(yù)防的可行性,討論經(jīng)濟(jì)價(jià)值和社會(huì)價(jià)值等主流價(jià)值。第四部分研究的主要內(nèi)容為:情境預(yù)防理論在公交縱火犯罪防控中的具體應(yīng)用。首先,以情境預(yù)防理論為視角引入情境預(yù)防的方法論。其次,討論公交縱火犯罪的特定情境因素。最后,全方位分析公交縱火犯罪的具體情境預(yù)防策略。本文的創(chuàng)新點(diǎn)主要有:1、將情境預(yù)防導(dǎo)入特定犯罪防控中研究可行性;2、全面分析公交縱火犯罪的成因,結(jié)合情境預(yù)防理論,提出具體可操作的預(yù)防策略。
[Abstract]:Since the reform and opening up, China has insisted on taking development as its first priority and economic construction as its central task. Now it has become one of the world's economic powers, and the people's living standards have generally reached a well-off level. However, with the intensification of social transformation and social stratum differentiation, the distribution of social resources is increasingly uneven, the gap between the rich and the poor is expanding, and the construction of a harmonious society is facing a severe test. In recent years, public transport arson-like individual extreme violence, a serious threat to social stability. From the perspective of crime situation prevention theory, this paper focuses on interpreting the situation factors of public transport arson crime, constructing a situational prevention system, and reforming the specific situation conducive to the occurrence of public transport arson crime, in order to increase the risk and difficulty of public transport arson behavior. Elimination of opportunities and conditions for crime The full text can be divided into four parts. The first part of the main content of the study is: the status quo and causes of public transport arson in China. First of all, this kind of cases in recent years are analyzed synthetically, their characteristics and causes are summarized, and the present situation is summarized. Secondly, it describes the existing countermeasures of public transport arson, and interprets the existing problems. The second part of the main content of the study is: public transport arson crime situation prevention prospects. Firstly, it introduces the theoretical background of situational prevention, and explores briefly the theory of situational prevention, including its preventive strategies and existing challenges. Secondly, show the controversy and prospect of situational prevention combined with reality. The third part of the main content of the study: the study of situational prevention into the prevention of public transport arson crime positive significance. First of all, it summarizes the differences between situational prevention and judicial prevention, social prevention, emphasizes the advantages of situational prevention theory, and focuses on the necessity of introducing situational prevention into public transport arson. Secondly, it demonstrates the feasibility of situation prevention of public transportation arson crime, and discusses the main value such as economic value and social value. The fourth part focuses on the application of situational prevention theory in the prevention and control of public transport arson. Firstly, the methodology of situational prevention is introduced from the perspective of situational prevention theory. Secondly, the specific situational factors of public transport arson are discussed. Finally, the situation prevention strategy of public transportation arson crime is analyzed in all directions. The main innovation of this paper is: 1, introducing situational prevention into specific crime prevention and control research feasibility 2, comprehensively analyzing the causes of public transport arson crime, combining with situational prevention theory, putting forward specific operational prevention strategies.
