【摘要】： 城市規(guī)劃是根據(jù)一定時期經(jīng)濟社會發(fā)展目標和要求,對一定時期內(nèi)城市的經(jīng)濟和社會發(fā)展、土地利用、空間布局以及各項建設的綜合部署、具體安排和實施管理。改革開放以來,我國的城市建設取得了令世人矚目的成就,創(chuàng)建了一批世界聞名的新興城市,如北京、上海、廣州、深圳等。城市規(guī)劃的作用也越來越突出,地位越來越重要。它與城市中每個人的生活息息相關,關系到城市總體功能的有效發(fā)揮,關系到經(jīng)濟、社會、人口、資源、環(huán)境的協(xié)調(diào)發(fā)展,關系到城市的未來發(fā)展。 職務犯罪是一種性質(zhì)最為嚴重的腐敗形式,它是國家工作人員利用職務之便進行非法活動,以及違反職責履行的要求,不履行或者不正確履行職務,侵害國家機關的管理活動,侵害職務行為的廉潔性,致使國家和人民的利益遭受重大損失,依照刑法應當受到刑罰處罰的犯罪行為的總稱。它比一般刑事犯罪具有更大的欺騙性和危害性。它不僅直接侵害國家機關的正常活動和管理職能,破壞國家秩序,危害經(jīng)濟的健康發(fā)展和社會公平正義,給國家和人民財產(chǎn)造成嚴重損失,甚至危及人民群眾的生命安全,而且嚴重損害黨和政府的形象和威信,激化社會矛盾,敗壞社會風氣,危害國家的政治穩(wěn)定。 但是由于種種原因,近年來,城市規(guī)劃領域內(nèi)的職務犯罪現(xiàn)象也大量產(chǎn)生。由于房地產(chǎn)暴利行業(yè)的利益誘惑巨大,規(guī)劃領域內(nèi)行政權力的尋租空間寬闊,以及我國目前法律法規(guī)不完善等原因,使得規(guī)劃領域內(nèi)頻繁爆發(fā)涉案金額大、牽連人員廣、犯罪性質(zhì)惡劣、作案手段隱蔽、社會危害性嚴重的職務犯罪。住房和城鄉(xiāng)建設部部長姜偉新2008年9月26日在住房和城鄉(xiāng)建設系統(tǒng)廉政建設工作電視電話會議上在上述會議上坦陳,住房和城鄉(xiāng)建設系統(tǒng)反腐倡廉形勢不僅嚴峻,而且是腐敗現(xiàn)象的多發(fā)區(qū)、高發(fā)區(qū)。 針對這一現(xiàn)象,本文首先描述了城市規(guī)劃領域內(nèi)職務犯罪的基本現(xiàn)狀:即城市規(guī)劃領域職務犯罪的表現(xiàn)形式、主要類型、特點、發(fā)展趨勢和社會危害。其次,本文具體分析了城市規(guī)劃領域內(nèi)職務犯罪的成因:即利益誘惑巨大,行政權力尋租空間寬闊,法律法規(guī)不完善。最后針對上述原因剖析,本文提出了預防措施:即,完善利益導向機制,壓縮行政權力尋租空間,完善法律法規(guī)。 我國的城市化進程才剛剛起步不久,前路漫漫,職務犯罪如同一塊巨石,阻擋著我國的城市建設和社會發(fā)展。筆者作為在城市規(guī)劃領域內(nèi)的一名公職人員,深感反腐敗的迫切性和重要性,寫此文試析城市規(guī)劃領域內(nèi)職務犯罪的原因,并對預防之抒己之淺見。
[Abstract]:Urban planning is based on the economic and social development goals and requirements of a certain period of time, urban economic and social development, land use, spatial layout and various construction of the comprehensive deployment, specific arrangements and implementation of management. Since the reform and opening up, China's urban construction has made remarkable achievements, creating a number of world-famous new cities, such as Beijing, Shanghai, Guangzhou, Shenzhen and so on. The function of urban planning is more and more prominent, the position is more and more important. It is closely related to the life of everyone in the city, to the effective exertion of the overall function of the city, to the coordinated development of economy, society, population, resources and environment, and to the future development of the city. Job-related crime is the most serious form of corruption in nature. It is used by state functionaries to carry out illegal activities and violate the requirements of performing their duties, fail to perform their duties or perform their duties incorrectly, and infringe upon the administrative activities of state organs. The general term of crimes that infringe upon the integrity of duty behavior and cause great losses to the interests of the state and the people and should be punished according to the criminal law. It is more deceptive and harmful than ordinary criminal offences. It not only directly infringes on the normal activities and management functions of state organs, undermines the order of the state, endangers the healthy development of the economy and social equity and justice, causes serious losses to the property of the state and the people, and even endangers the lives and safety of the masses of the people. Moreover, it seriously damages the image and prestige of the Party and the government, intensifies social contradictions, destroys social ethos and endangers the country's political stability. However, due to various reasons, in recent years, the phenomenon of crime in the field of urban planning is also a large number. Because of the huge interest temptation of the real estate profiteering industry, the wide space for rent-seeking in the planning field, and the imperfect laws and regulations at present in our country, the frequent outbreak of large amounts of money involved in the planning field and the wide involvement of personnel, A duty crime with a bad nature, hidden criminal means and serious social harmfulness. On September 26, 2008, Jiang Weixin, Minister of Housing and Urban-Rural Construction, admitted at the above-mentioned meeting that the situation of combating corruption in the housing and urban-rural construction system is not only grim. Moreover, it is a frequent and high incidence area of corruption. In view of this phenomenon, this paper first describes the basic status quo of job-related crime in the field of urban planning: the form, main types, characteristics, development trend and social harm of the crime in the field of urban planning. Secondly, this paper analyzes the causes of the crime of duty in the field of urban planning: the huge temptation of interest, the wide space of rent-seeking of administrative power, the imperfect laws and regulations. Finally, according to the above reasons, this paper puts forward the preventive measures: perfect the benefit oriented mechanism, reduce the administrative power rent-seeking space, perfect the laws and regulations. The process of urbanization in our country is just beginning, the road ahead is long, the crime of duty is like a huge stone, which obstructs the urban construction and social development of our country. As a public official in the field of urban planning, the author deeply feels the urgency and importance of fighting corruption, analyzes the causes of duty crime in the field of urban planning, and expresses his views on prevention.
