警察職業(yè)院校開設(shè)人權(quán)法課程的思考

【摘要】: 2004年,“國家尊重和保障人權(quán)”載入憲法標(biāo)志著人權(quán)成為我國立國的基本價值取向之一。人權(quán)教育的重要性也日益凸現(xiàn)出來;诖髮W(xué)階段的人權(quán)教育主要以人權(quán)法教學(xué)為主和警察、法律工作者又是人權(quán)教育的主要對象這兩個緣由,筆者提出在“警察職業(yè)院校開設(shè)人權(quán)法課程”的命題,通過對警察職業(yè)院校開設(shè)人權(quán)法課程的一般意義的闡述和對筆者所在的某司法警官職業(yè)學(xué)院學(xué)生人權(quán)意識和人權(quán)價值觀情況的實證分析,闡明了在警察職業(yè)院校開設(shè)人權(quán)法的重要性和必要性,提出警察職業(yè)院校開設(shè)人權(quán)法課程的初步構(gòu)想。 文章的第一部分分析了人權(quán)法教學(xué)和人權(quán)教育的關(guān)系,闡明了在警察院校進行人權(quán)法教學(xué)的意義,指出人權(quán)法應(yīng)作為一門獨立的法學(xué)課程進行設(shè)置,但也需要正視其邊緣化的現(xiàn)狀。 文章的第二部分通過對筆者所在的某司法警官職業(yè)學(xué)院學(xué)生人權(quán)意識和人權(quán)價值觀情況的問卷調(diào)查的實證分析,闡述了警察職業(yè)學(xué)院有開設(shè)人權(quán)法課程的現(xiàn)實必要和現(xiàn)實需求。 文章的第三部分是筆者對警察職業(yè)院校開設(shè)人權(quán)法課程的初步構(gòu)想。在課程目標(biāo)上,筆者提出人權(quán)法教學(xué)的目標(biāo)主要是“塑造人權(quán)態(tài)度”;在課程內(nèi)容上安排為人權(quán)基本原理和實務(wù)兩部分,希望學(xué)生能夠用人權(quán)基本原理分析人權(quán)熱點問題;在課程的時間安排上建議在二年級下期或三年級的上期;在教學(xué)方法上應(yīng)注意處理好理論與知識、意識與信念的關(guān)系,強調(diào)了互動式教學(xué)的重要性和教學(xué)過程中現(xiàn)代化的教學(xué)工具的使用。
[Abstract]:In 2004, "the state respects and protects human rights" is enshrined in the Constitution, which marks that human rights have become one of the basic values of our country. The importance of human rights education is also increasingly evident. Based on the two reasons that human rights education in university is mainly based on the teaching of human rights law and that the police are the main objects of human rights education, the author puts forward the proposition that "the course of human rights law should be offered in police vocational colleges". Through the elaboration of the general significance of the course of human rights law in the police vocational college and the empirical analysis of the human rights consciousness and human rights values of the students in a judicial police professional college, This paper expounds the importance and necessity of establishing human rights law in police vocational colleges, and puts forward a preliminary conception of the course of human rights law in police vocational colleges. The first part of the article analyzes the relationship between human rights law teaching and human rights education, expounds the significance of human rights law teaching in police academies, and points out that human rights law should be set up as an independent law course. But it also needs to face up to its marginalization. The second part of the article through the author of a judicial police professional college students' human rights awareness and human rights values of the empirical analysis of the situation of the police vocational college to set up the course of human rights law practical necessity and practical needs. The third part of the article is the author of the police vocational colleges to set up a course in human rights law. In terms of curriculum objectives, the author puts forward that the aim of teaching human rights law is mainly to "mold human rights attitude", and to arrange the course contents as two parts: the basic principles of human rights and the practice, hoping that students can use the basic principles of human rights to analyze the hot issues of human rights. In the course schedule, it is suggested that in the second grade or the third grade, attention should be paid to the relationship between theory and knowledge, consciousness and belief in teaching methods. The importance of interactive teaching and the use of modern teaching tools are emphasized.
