【摘要】：目的探討交通事故致頸椎損傷后傷殘等級(jí)和休息、護(hù)理、營(yíng)養(yǎng)時(shí)限的法醫(yī)學(xué)鑒定,以及頸部損傷、原有疾患與后遺癥之間因果關(guān)系法醫(yī)學(xué)鑒定的原則與方法。方法收集64例頸椎損傷的傷殘等級(jí)鑒定案例,對(duì)相關(guān)資料/數(shù)據(jù)進(jìn)行統(tǒng)計(jì)分析。收集交警部門(mén)反饋的涉及傷病關(guān)系案件的處理結(jié)果,了解案件雙方當(dāng)事人對(duì)鑒定結(jié)論的認(rèn)可程度。結(jié)果隨著對(duì)頸椎損傷后傷殘?jiān)u定案件中原發(fā)病的認(rèn)識(shí)逐漸增加,相應(yīng)頸椎損傷涉及傷病關(guān)系鑒定的案件也日益增多;在受理的頸椎損傷傷病關(guān)系案件中,均按照傷病關(guān)系理論進(jìn)行鑒定,案件處理機(jī)關(guān)(交通警察)以及雙方當(dāng)事人對(duì)鑒定結(jié)論均表示滿意。結(jié)論對(duì)于各種頸椎損傷進(jìn)行傷殘等級(jí)和"三期"鑒定的案例,由于損傷機(jī)制不同,自身原有頸椎健康程度不同,所造成的后果也不盡相同,鑒定中應(yīng)考慮原有疾病對(duì)傷殘等級(jí)的影響。
[Abstract]:Objective to explore the principles and methods of forensic medical identification of the degree of disability, rest, nursing care, nutritional time limit, and causality between cervical injury, original disease and sequelae caused by traffic accident. Methods 64 cases of cervical spine injury were collected and analyzed statistically. Collect the result of dealing with the cases related to injury and injury, and understand the degree of approval of the parties involved in the case. Results with the increasing awareness of the primary diseases in the post-injury assessment cases, the number of the corresponding cervical spine injuries involving the identification of injury and injury relationship is also increasing; in the cases of cervical spine injury and injury relationship, According to the theory of the relationship between injury and injury, both parties are satisfied with the conclusion. Conclusion for the cases of different cervical vertebrae injury with disability grade and "three stages", because of the different injury mechanism, the original cervical vertebrae health degree is different, the consequence is also different. The influence of the original disease on the disability grade should be considered in the appraisal.
