【摘要】： 公安警察(以下簡稱警察)職務(wù)犯罪是指國家警察機(jī)關(guān)的警察在執(zhí)行職務(wù),履行職責(zé)中,故意或過失地侵害國家對警察職務(wù)活動的管理職能,依照刑法應(yīng)當(dāng)受到刑罰處罰的犯罪行為的總稱。自上世紀(jì)90年代以來,我國警察職務(wù)犯罪整體呈上升趨勢并居高不下,且在以后較長的時期內(nèi)還可能呈上升趨勢。警察職務(wù)犯罪的危害可歸納為四個方面。一是對國家政權(quán)的危害;二是對法律秩序的危害;三是對社會基本價值信仰的危害;四是對警察形象的危害。當(dāng)前警察職務(wù)犯罪的特點(diǎn)可以概括為:犯罪的隱蔽性、犯罪的即時性、犯罪的暴力性、犯罪的抗法性和犯罪客體的復(fù)雜性。警察職務(wù)犯罪的原因既有社會、機(jī)制的原因,又有個體、心理的原因。社會原因主要包括文化失導(dǎo)、發(fā)展競爭不公平、懲處不力。機(jī)制原因主要包括司法體制的弊端、地方警察體制的弊端、行政執(zhí)法和刑事執(zhí)法權(quán)集于一身的弊端、現(xiàn)行領(lǐng)導(dǎo)決策自身的弊端、權(quán)力結(jié)構(gòu)的矛盾、監(jiān)督體制的弊端。心理原因主要包括心理失衡扭曲、面對陰暗面多、特權(quán)思想作怪、僥幸心理投機(jī)。在警察職務(wù)犯罪的防治上要注意四個方面,一是要加大打擊力度,預(yù)防警察犯罪,具體包括加大打擊力度,營造反警察職務(wù)犯罪的社會氛圍;加強(qiáng)警察職務(wù)犯罪預(yù)防立法,預(yù)防、減少警察犯罪。二是要推行體制改革,堵塞弊端漏洞,具體包括推行司法改革,加大監(jiān)督力度;改革警務(wù)體制,建立國家警察;合理配置警察權(quán)力,確保有效地運(yùn)作;改革權(quán)力結(jié)構(gòu),均衡警察內(nèi)部權(quán)力。三是要加強(qiáng)教育培訓(xùn),完善管理制度,具體包括加強(qiáng)警察職業(yè)道德建設(shè);端正執(zhí)法觀念和思想;完善警察管理的人事制度;注重樣板的激勵效應(yīng)。四是要建立多方監(jiān)控,力求監(jiān)督實(shí)效,具體包括建立完善的警務(wù)督察機(jī)制;加強(qiáng)對警察的檢察監(jiān)督;建立健全全方位的監(jiān)督機(jī)制。
[Abstract]:The duty crime of the public security police (hereinafter referred to as "the police") refers to the intentional or negligent infringement by the state of the administrative function of the police in the course of carrying out their duties and performing their duties, A general term for a criminal act punishable by a penalty in accordance with the criminal law. Since the 1990s, the overall police duty crime in China has been on the rise and remains high, and may also be on the rise for a long time to come. The harm of police duty crime can be summarized into four aspects. The first is the harm to the state power, the second is the harm to the legal order, the third is the harm to the belief in the basic value of society, and the fourth is the harm to the image of the police. The characteristics of current police duty crime can be summarized as follows: concealment of crime, immediacy of crime, violence of crime, resistance to law and complexity of object of crime. The reason of police duty crime is not only society, mechanism, but also individual and psychology. Social reasons mainly include cultural misdirection, unfair development competition and ineffective punishment. The main causes of the mechanism include the malpractice of the judicial system, the malpractice of the local police system, the malpractice of the administrative law enforcement and the criminal law enforcement power, the malpractice of the current leadership decision-making itself, the contradiction of the power structure and the malpractice of the supervisory system. The psychological reasons include the distortion of psychological imbalance, the face of more dark side, privileged thoughts, and lucky psychological speculation. We should pay attention to four aspects in the prevention and control of police job-related crimes. First, we should step up our efforts to crack down and prevent police crimes, specifically, we should step up our efforts to crack down and create a social atmosphere against police job-related crimes, and strengthen the legislation on the prevention of police job-related crimes. To prevent and reduce police crime. Second, it is necessary to carry out the reform of the system and plug the loopholes of malpractices, including the promotion of judicial reform and the strengthening of supervision; the reform of the police service system and the establishment of the national police; the rational allocation of police power to ensure effective operation; and the reform of the power structure. Balance the internal power of the police. Third, it is necessary to strengthen education and training, perfect the management system, including strengthening the construction of police professional ethics, correct the concept and thought of law enforcement, perfect the personnel system of police management, and pay attention to the incentive effect of the model. Fourth, it is necessary to establish multi-party monitoring, and strive for the effectiveness of supervision, including the establishment of a sound police supervision mechanism; strengthen the procuratorial supervision of the police; establish and improve the omni-directional supervision mechanism.
