【摘要】：行刑社會化是人類刑罰歷史演進(jìn)的必然趨勢,是一種新的行刑理念和行刑方式。社區(qū)矯正是社會文明發(fā)展到一定歷史階段的必然產(chǎn)物,也是社會不斷進(jìn)步、刑事政策日趨理性化的重要標(biāo)志。社區(qū)矯正契合當(dāng)前行刑社會化理念,是行刑社會化思想的一種主要形式,是行刑社會化的重要組成部分。我國由2003年最初的6個省、自治區(qū)、直轄市試點(diǎn)到目前在全國范圍試行社區(qū)矯正,在維護(hù)社會和諧穩(wěn)定,降低刑罰執(zhí)行成本等方面發(fā)揮了重要作用,在完善我國非監(jiān)禁刑罰執(zhí)行制度方面做出了有益探索,積累了豐富經(jīng)驗(yàn)。但同時,由于在推進(jìn)社區(qū)矯正工作中存在的很多問題和阻礙,嚴(yán)重影響和制約著社區(qū)矯正制度功能的發(fā)揮和刑罰目的的實(shí)現(xiàn)。本文提出,為推進(jìn)社區(qū)矯正工作,完善社區(qū)矯正制度,應(yīng)在借鑒國外成熟經(jīng)驗(yàn)的基礎(chǔ)上,立足本國的國情和社區(qū)矯正試點(diǎn)實(shí)踐,從刑事司法理念的嬗變和社區(qū)矯正立法、運(yùn)作、機(jī)構(gòu)、人員隊(duì)伍等諸多層面進(jìn)行系統(tǒng)的理性建設(shè),逐步建構(gòu)一個既與行刑社會化理念相適應(yīng),又具有鮮明中國特色的社區(qū)矯正制度,從而促進(jìn)我國刑罰執(zhí)行機(jī)制的文明。
[Abstract]:The socialization of execution is the inevitable trend of the historical evolution of human penalty, and it is a new concept and method of execution. Community correction is the inevitable outcome of the development of social civilization to a certain historical stage, and it is also an important symbol of the continuous progress of society and the rationalization of criminal policy. Community correction is a main form of socialization of execution and an important part of socialization of execution. From the first six provinces, autonomous regions and municipalities directly under the Central Government in 2003 to the current nationwide trial of community correction, China has played an important role in maintaining social harmony and stability, reducing the cost of penalty execution, and so on. It has made beneficial exploration and accumulated rich experience in perfecting the execution system of non-custodial penalty in our country. But at the same time, because of many problems and obstacles in promoting community correction, it seriously affects and restricts the function of community correction system and the realization of penalty purpose. In order to promote the work of community correction and perfect the system of community correction, this paper puts forward that in order to improve the system of community correction, we should learn from the mature experience of foreign countries, base on the national conditions of our country and the pilot practice of community correction, and operate from the evolution of the concept of criminal justice and the legislation of community correction. In order to promote the civilization of penalty execution mechanism in our country, the institution, personnel team and so on carry on the systematic rational construction, gradually constructs a community correction system which not only adapts to the concept of socialization of execution of punishment, but also has distinct Chinese characteristics, thus promotes the civilization of the execution mechanism of punishment in our country.
