【摘要】：刑事犯罪主體、對象、工具、犯罪所得、犯罪痕跡等構(gòu)成案件事實的要素跨國界流動的情形日益增多,在許多場合,偵查機關(guān)僅在國內(nèi)進行偵查取證活動已無法適應(yīng)有效打擊犯罪的需要。因此,通過國際偵查合作進行跨國取證,日顯重要和必要。我國關(guān)于國際偵查合作背景下所取得之境外證據(jù)的可采性問題的相關(guān)法律規(guī)范嚴重不足,因此有必要結(jié)合國際偵查合作的特點和我國的實際需要,完善國際偵查合作背景下所取得之境外證據(jù)可采性問題的相關(guān)規(guī)范,并積極探索調(diào)查取證請求國法律準(zhǔn)據(jù)法模式。
[Abstract]:Criminal subjects, objects, instrumentalities, proceeds of crime, traces of crime and other elements that constitute the facts of a case are increasingly flowing across national borders. On many occasions, The investigation organ can not meet the need of cracking down on crime only in our country. Therefore, it is increasingly important and necessary to conduct transnational forensics through international investigative cooperation. The relevant legal norms on the admissibility of overseas evidence obtained in the context of international investigation cooperation are seriously inadequate, so it is necessary to combine the characteristics of international investigative cooperation and the actual needs of our country. Improve the relevant norms of the admissibility of overseas evidence obtained in the context of international investigative cooperation and actively explore the mode of law applicable to the requesting country of investigation.
