【摘要】： 一個(gè)國(guó)家、一個(gè)民族如果沒有英雄,沒有精英,這個(gè)國(guó)家和民族不僅不可能興旺發(fā)達(dá),還可能衰敗、滅亡。精英是國(guó)家、民族和社會(huì)中對(duì)民眾有較大影響的優(yōu)秀分子。精英在任何社會(huì)中都只占很小的比例,但對(duì)社會(huì)卻有極大的影響力和控制力。精英犯罪是我國(guó)當(dāng)前社會(huì)轉(zhuǎn)型時(shí)期突出的社會(huì)問題。精英犯罪呈現(xiàn)出以下特點(diǎn):作案手段高超,偵破難度大;關(guān)系網(wǎng)錯(cuò)綜復(fù)雜,處理難度大;社會(huì)危害后果嚴(yán)重;敗壞社會(huì)風(fēng)氣,造成信任危機(jī)等。學(xué)界對(duì)精英犯罪的研究還比較少,但對(duì)于職務(wù)犯罪、白領(lǐng)犯罪等的研究則比較深入。職務(wù)犯罪、白領(lǐng)犯罪與精英犯罪在某些方面有相似之處,而區(qū)別也是比較明顯的。首先,從犯罪主體來說,精英犯罪的主體是精英,但職務(wù)犯罪、白領(lǐng)犯罪的主體只有一部分是本文意義上的精英,三者在內(nèi)涵上是一種交叉關(guān)系。其次,在客觀行為上,職務(wù)犯罪、白領(lǐng)犯罪表現(xiàn)為利用職務(wù)上、業(yè)務(wù)上的便利,而精英犯罪則不一定利用職務(wù)上、業(yè)務(wù)上的便利。 所以,根據(jù)精英犯罪的特點(diǎn),對(duì)精英犯罪的成因進(jìn)行研究,并找出可行的預(yù)防之策就是一件很有必要的事情。精英犯罪與職務(wù)犯罪、白領(lǐng)犯罪都可由對(duì)權(quán)力和金錢的過度追求以及法律制度不完善、監(jiān)督不力等導(dǎo)致。但導(dǎo)致精英犯罪的因素還有一些特別的地方,如歷史因素、社會(huì)道德因素、精英對(duì)特定物品的欲求等。 由于精英群體擁有很高的聲望和影響力,所以很容易逃避監(jiān)督和制約。鑒于上述原因,我們?cè)谔岢鲱A(yù)防措施時(shí),除了采用加強(qiáng)制約和監(jiān)督等與職務(wù)犯罪、白領(lǐng)犯罪相似的預(yù)防措施外,還應(yīng)特別加強(qiáng)精英的自我教育,使精英將守法意識(shí)內(nèi)化,并最終表現(xiàn)為守法行為。這也是作為精英的應(yīng)有之義。對(duì)精英犯罪的各項(xiàng)預(yù)防措施不是割裂的,而是有機(jī)結(jié)合、共同發(fā)生作用的。
[Abstract]:If a country, a nation without heroes and elites, this country and nation not only can not flourish, but also may decline and perish. Elite is the country, the nation and society has a greater impact on the people of the outstanding elements. The elite make up only a small proportion of any society, but have great influence and control over the society. Elite crime is a prominent social problem in the period of social transformation. Elite crimes show the following characteristics: superb means of crime, great difficulty in detection; complicated network, difficult to deal with; serious social harm consequences; corrupt social atmosphere, cause trust crisis, etc. There are few researches on elite crime, but on duty crime and white-collar crime. Duty crime, white-collar crime and elite crime have similarities in some aspects, and the difference is more obvious. First of all, from the subject of crime, the main body of elite crime is elite, but duty crime, white-collar crime of the subject is only part of the elite in the meaning of this article, the three are a kind of intersecting relationship in connotation. Secondly, in the objective behavior, duty crime, white-collar crime is the use of duty, business convenience, while elite crime does not necessarily use the position, business convenience. Therefore, according to the characteristics of elite crime, it is necessary to study the causes of elite crime and find out feasible preventive measures. Elite crime, duty crime and white-collar crime can be caused by excessive pursuit of power and money, imperfect legal system and weak supervision. However, there are some special factors that lead to elite crime, such as historical factors, social and moral factors, elite desire for specific items and so on. Because elite groups have high prestige and influence, it is easy to avoid supervision and restriction. In view of the above reasons, in proposing preventive measures, in addition to adopting preventive measures similar to duty crimes and white-collar crimes, such as strengthening restrictions and supervision, we should also strengthen the self-education of the elite, so that the elite can internalize their consciousness of abiding by the law. And finally behave as law-abiding behavior. This is also the proper meaning of being an elite. The preventive measures against elite crime are not fragmented, but organic combination and joint effect.
