凡是阻礙城市規(guī)劃管理工作人員依法執(zhí)行公務(wù)，致使城市規(guī)劃管理與行政執(zhí)法無法順利進(jìn)行的，就應(yīng)由公安機(jī)關(guān)依照治安管理處罰條例的規(guī)定進(jìn)行處罰。具體地說，主要有以下兩種情況：
1．城市規(guī)劃管理工作人員在依法對于城市規(guī)劃區(qū)內(nèi)的建設(shè)活動進(jìn)行監(jiān)督檢查，以及在監(jiān)督檢查過程中對于違法占地和建設(shè)活動進(jìn)行制止時，遭到辱罵、毆打及其他嚴(yán)重?zé)o理方式的故意拒絕，致使有關(guān)公務(wù)無法正常進(jìn)行，但有關(guān)違法行為情節(jié)尚不構(gòu)成觸犯刑律的。
2．城市規(guī)劃管理工作人員在依法對于有關(guān)違法占地與違法建設(shè)進(jìn)行現(xiàn)場強行處置時，遭到無理拒絕，致使城市規(guī)劃與建設(shè)工作的正常秩序受到影響，但有關(guān)違法行為情節(jié)尚不構(gòu)成觸犯刑律的。
各級城市規(guī)劃行政主管部門工作人員在依法執(zhí)行有關(guān)規(guī)劃管理公務(wù)時，應(yīng)根據(jù)具體情況，及時通知并配合公安機(jī)關(guān)，對于有關(guān)違法行為的責(zé)任者進(jìn)行必要的處罰，以保證城市規(guī)劃管理工作的順利進(jìn)行。
