【摘要】：犯罪的主觀心理分析,經(jīng)歷了從單一犯罪心理到諸多犯罪心理的發(fā)展后,又出現(xiàn)了犯罪分析法到要素分析法的新變化。與要求具體犯罪構(gòu)成要件中僅能有一種罪過心理的傳統(tǒng)犯罪分析方法不同,要素分析法認為,不同的客觀要素可以具有不同的主觀罪過,一個犯罪構(gòu)成中可以同時存在多種主觀罪過形式。采用要素分析法,能更好地解釋復(fù)雜罪過、加重結(jié)果犯的主觀罪過、主觀的超過要素等問題,還能為刑法疑難問題提供新的思考路徑。
[Abstract]:The subjective psychological analysis of crime has experienced the new change from the criminal analysis to the factor analysis after the development of the single criminal psychology to many criminal psychology. It is different from the traditional crime analysis method, which is only able to have a kind of crime psychology, and the factor analysis method holds that different objective elements can be made up. There are different subjective crimes. In the constitution of a crime, there are various forms of subjective crime. The use of factor analysis can better explain the complex crime, aggravate the subjective crime of the result offense and the subjective factors, and can also provide a new way of thinking for the difficult problem of criminal law.
