【摘要】：對社區(qū)矯正性質的認識決定了未來的制度設計。對社區(qū)矯正性質的界定要考慮制度目的與國情。通過對我國官方關于社區(qū)矯正的描述,可以發(fā)現(xiàn)我國的社區(qū)矯正既有對罪犯限制人身自由,進行懲罰教育,以實現(xiàn)特殊預防的效果,又含有發(fā)動社會力量對罪犯的不良心理和行為進行矯正,以促使其再社會化的目的。結合我國社區(qū)矯正的適用對象、執(zhí)行主體、矯正措施等因素,可以認為我國的社區(qū)矯正既不是非監(jiān)禁刑罰執(zhí)行方式,也不能簡單地與社會福利等同,而是一種對犯罪人實施的兼有刑事處罰與社會待遇雙重屬性的綜合性非監(jiān)禁刑事處遇方式。
[Abstract]:The understanding of the nature of community correction determines the future system design.The definition of the nature of community correction should consider the purpose of the system and national conditions.Through the official description of community correction in our country, we can find that the community correction in our country not only restricts the personal freedom of criminals, but also carries out punishment education, in order to realize the effect of special prevention.It also contains the purpose of arousing social forces to correct criminals' bad psychology and behavior in order to promote their re-socialization.Combining with the applicable object, subject of execution, corrective measures and other factors of community correction in our country, it can be concluded that community correction in our country is neither a non-custodial punishment execution method, nor can it be simply the same as social welfare.It is a comprehensive non-custodial criminal punishment which has dual attributes of criminal punishment and social treatment.
