【摘要】：社區(qū)矯正制度起源于20世紀(jì)30年代至50年代的歐美國家,并在全球范圍內(nèi)得到迅速發(fā)展。我國社區(qū)矯正制度仍處于剛剛起步的初級(jí)階段,從2003年起,我國最高人民法院、最高人民檢察院、公安部以及司法部共同提出大力推進(jìn)社區(qū)矯正試點(diǎn)工作,至今已經(jīng)歷了十三年時(shí)間,經(jīng)過這些年的工作實(shí)踐,社區(qū)矯正工作不但取得了較好的社會(huì)效果,還歸納了不少先進(jìn)經(jīng)驗(yàn),但是我國對(duì)社區(qū)矯正工作的研究仍停留在概念、性質(zhì)方面,對(duì)于社區(qū)矯正的監(jiān)督管理方面的研究少之又少。筆者立足于莊河市社區(qū)矯正工作實(shí)際,深入剖析莊河市現(xiàn)有社區(qū)矯正監(jiān)管模式,并在此基礎(chǔ)上提出優(yōu)化莊河市社區(qū)矯正監(jiān)管模式的方案設(shè)計(jì)及具體建議,希望筆者粗淺的分析能為莊河市社區(qū)矯正的開展提供參考,促進(jìn)莊河市社區(qū)矯正工作不斷完善。全文分為五章,第一章介紹了開展社區(qū)矯正工作的背景、研究意義、相關(guān)名詞解釋及國內(nèi)外對(duì)于社區(qū)矯正工作的研究現(xiàn)狀,介紹了本文的研究方法和技術(shù)路線。第二章介紹了莊河市社區(qū)矯正工作基本概況,包括莊河市社區(qū)矯正對(duì)象基本情況和特點(diǎn)、社區(qū)矯正機(jī)構(gòu)及隊(duì)伍建設(shè)情況、監(jiān)管程序、莊河市社區(qū)矯正工作的主要經(jīng)驗(yàn)和做法,并從立法、執(zhí)法、操作、效果、社會(huì)認(rèn)可度等層面歸納出莊河市社區(qū)矯正工作中所暴露出的缺陷,且總結(jié)出主要成因,即法律依據(jù)不充分、缺少專業(yè)的社區(qū)矯正隊(duì)伍、監(jiān)管評(píng)估制度不健全、社會(huì)支持未形成合力。第三章結(jié)合國內(nèi)外先進(jìn)理論及實(shí)踐經(jīng)驗(yàn),提出優(yōu)化莊河市社區(qū)矯正監(jiān)管模式的優(yōu)化方案設(shè)計(jì),從機(jī)構(gòu)設(shè)置、隊(duì)伍建設(shè)、機(jī)構(gòu)職責(zé)、保障措施四個(gè)方面加以闡述,并從方案的可行條件、經(jīng)費(fèi)的基本構(gòu)成及計(jì)算方式、預(yù)期效果等方面對(duì)優(yōu)化方案的可行性進(jìn)行論證。第四章主要是針對(duì)莊河市社區(qū)矯正監(jiān)管模式優(yōu)化方案提出具體建議,即加大社區(qū)矯正工團(tuán)隊(duì)的建設(shè)力度；改進(jìn)社區(qū)矯正監(jiān)管形式；強(qiáng)化社區(qū)矯正幫扶實(shí)效；加強(qiáng)信息化建設(shè)。第五章為結(jié)論部分,對(duì)全文進(jìn)行總結(jié)陳述,表明文章的主要觀點(diǎn),為莊河市社區(qū)矯正工作的發(fā)展提出自己的觀點(diǎn)和想法。
[Abstract]:Community correction system originated in Europe and America from 1930s to 1950s, and developed rapidly all over the world.Our community correction system is still in its infancy. Since 2003, the Supreme people's Court, the Supreme people's Procuratorate, the Ministry of Public Security and the Ministry of Justice have jointly proposed to vigorously promote the pilot work of community correction.After 13 years of work practice, community correction has not only achieved good social results, but also summed up a lot of advanced experience. However, the research on community correction in our country is still on the concept.In nature, there is little research on supervision and management of community correction.Based on the practice of community correction in Zhuanghe City, the author deeply analyzes the existing supervision mode of community correction in Zhuanghe City, and on this basis puts forward the scheme design and concrete suggestions for optimizing the supervision mode of community correction in Zhuanghe City.I hope the author can provide reference for the development of community correction in Zhuanghe City and promote the continuous improvement of community correction work in Zhuanghe City.The paper is divided into five chapters. The first chapter introduces the background, research significance, the explanation of related nouns and the research status of community correction at home and abroad, and introduces the research methods and technical route of this paper.The second chapter introduces the basic situation of the community correction work in Zhuanghe city, including the basic situation and characteristics of the community correction object in Zhuanghe city, the construction of the community correction organization and team, the supervision procedure, the main experience and practice of the community correction work in Zhuanghe city.And from the aspects of legislation, law enforcement, operation, effect and social recognition, the defects exposed in the community correction work in Zhuanghe City are summed up, and the main causes are summarized, that is, inadequate legal basis and lack of professional community correction team.Supervision and evaluation system is not perfect, social support has not formed a resultant force.The third chapter combines the advanced theory and practical experience at home and abroad, puts forward the optimization scheme design of the community correction supervision mode of Zhuanghe city, from four aspects of organization setup, team building, organization duty, safeguard measure.The feasibility of the optimization scheme is demonstrated from the feasible conditions of the scheme, the basic composition and calculation method of the funds, and the expected effect.The fourth chapter is mainly aimed at Zhuanghe City community correction supervision mode optimization program put forward specific suggestions, that is, to increase community correction team building; improve the form of community correction supervision; strengthen the effectiveness of community correction; strengthen the construction of information.The fifth chapter is the conclusion part, which summarizes the full text, shows the main points of the article, and puts forward its own views and ideas for the development of the community correction work in Zhuanghe city.
