【摘要】：犯罪構(gòu)造是犯罪構(gòu)成理論的概述性表述,進化論則是對一個主題在不同時間和條件下發(fā)展出來的不同形態(tài)的完整理論說明。中國古代雖然發(fā)現(xiàn)了犯罪會因構(gòu)成條件的不同而不同,但未形成相應(yīng)理論。英美法系國家的犯罪構(gòu)成理論則由于與政治制度、文化傳統(tǒng)緊密相聯(lián),較難看清全貌并加以借鑒。俄羅斯的犯罪構(gòu)成理論則是在不主張罪刑法定的前提下發(fā)展出了四要件理論,是犯罪構(gòu)成發(fā)展形態(tài)的一個特殊例證。以德國為代表的犯罪構(gòu)造經(jīng)歷了自然行為論、目的行為論、社會行為論和人格行為論,能夠完整地展示犯罪構(gòu)成理論發(fā)展的全過程。
[Abstract]:Crime structure is a general description of the theory of crime constitution, while evolution theory is a complete theoretical explanation of different forms of a subject developed in different time and conditions.Although the ancient Chinese discovered that the crime will be different according to the constitution condition, but did not form the corresponding theory.The theory of crime constitution in Anglo-American law system is closely related to political system and cultural tradition, so it is difficult to see the whole picture and draw lessons from it.Russia's theory of constitution of crime develops the theory of four elements on the premise of not advocating the legality of a crime, and it is a special example of the development of the constitution of crime.The crime structure represented by Germany has experienced the whole process of the development of the theory of criminal constitution, which includes natural behavior theory, teleological behavior theory, social behavior theory and personality behavior theory.
