【摘要】： 隨著經(jīng)濟的不斷發(fā)展,人們擁有的財富也越來越多,與之而來的財產(chǎn)犯罪也逐漸成為司法實踐當(dāng)中多發(fā)的一種犯罪類型。財產(chǎn)犯罪不僅侵害了被人的財產(chǎn)權(quán)和人身權(quán),而且嚴重擾亂了社會經(jīng)濟秩序。因此深入分析財產(chǎn)犯罪的形成原因具有重要的實踐意義。由于傳統(tǒng)刑法學(xué)以犯罪的階級性和和政治性作為分析的起點,僅僅站在公平正義的視角解釋財產(chǎn)犯罪,而忽視了財產(chǎn)犯罪的經(jīng)濟性,顯然有些不足之處。于是本文擬從法經(jīng)濟學(xué)的角度來探討財產(chǎn)犯罪的產(chǎn)生原因,并對如何預(yù)防財產(chǎn)犯罪作出經(jīng)濟學(xué)分析。本文的主要內(nèi)容可分為以下三個部分: 第一部分,主要介紹財產(chǎn)犯罪的經(jīng)濟分析概述,包括財產(chǎn)犯罪的概念、財產(chǎn)犯罪所侵害的法益等特征;經(jīng)濟分析的基本理論和分析方法,并論證了經(jīng)濟分析法分析研究財產(chǎn)犯罪是切實可行的。 第二部分,主要介紹法經(jīng)濟學(xué)研究財產(chǎn)犯罪的犯罪成本和犯罪收益的基本概念和內(nèi)涵,以及犯罪成本和犯罪收益是如何影響財產(chǎn)犯罪的;并在此基礎(chǔ)上給出了具體的犯罪決策模型和刑罰的最優(yōu)威懾水平,分析了財產(chǎn)犯罪的幾種特殊形態(tài)。 第三部分,主要介紹了站在法經(jīng)濟學(xué)的角度如何懲罰和預(yù)防財產(chǎn)犯罪,著重分析了各種主要的刑罰方法對于打擊預(yù)防財產(chǎn)犯罪的優(yōu)缺點,認為罰金刑在預(yù)防財產(chǎn)犯罪方面具有不可比擬的優(yōu)勢;同時,對財產(chǎn)犯罪適用死刑也作了簡要的法經(jīng)濟學(xué)分析,并結(jié)合我國《刑法》分則第五章及有關(guān)財產(chǎn)犯罪的規(guī)定,指出現(xiàn)有立法的缺陷,并提出修改建議。
[Abstract]:With the continuous development of economy, people have more and more wealth, and property crime has gradually become a common type of crime in judicial practice.Property crime not only infringes upon the property rights and personal rights, but also seriously disturbs the social and economic order.Therefore, it is of great practical significance to analyze the causes of property crime.Because the traditional criminal jurisprudence regards the class nature and the political nature of the crime as the starting point of analysis, it only explains the property crime from the angle of fairness and justice, but neglects the economy of the property crime, which obviously has some shortcomings.Therefore, this paper discusses the causes of property crime from the angle of law and economics, and makes an economic analysis on how to prevent property crime.The main contents of this paper can be divided into the following three parts:The first part mainly introduces the summary of economic analysis of property crime, including the concept of property crime, the characteristics of legal interests infringed by property crime, the basic theory and analytical methods of economic analysis,It also proves that it is feasible to analyze and study property crime by economic analysis method.The second part mainly introduces the basic concept and connotation of the crime cost and the crime proceeds of the property crime, and how the crime cost and the crime proceeds influence the property crime.On the basis of this, the author gives a specific crime decision model and the optimal deterrent level of penalty, and analyzes several special forms of property crime.The third part mainly introduces how to punish and prevent property crime from the angle of law and economics.The author thinks that the fine penalty has the incomparable advantage in preventing the property crime, at the same time, it also makes a brief legal and economic analysis on the application of the death penalty to the property crime, and combines with the fifth chapter of the sub-provision of the Criminal Law of our country and the provisions about the property crime.The defects of the existing legislation are pointed out, and suggestions for amendment are put forward.
