【摘要】：目的回顧性分析研究昆明地區(qū)涉及醫(yī)療爭議死亡事件的流行病學(xué)特點,探討醫(yī)療爭議死亡事件的法醫(yī)學(xué)鑒定問題,為有效預(yù)防醫(yī)療糾紛、醫(yī)療爭議死亡事件的法醫(yī)學(xué)鑒定和相關(guān)立法提供重要的實踐和理論依據(jù)。方法收集昆明醫(yī)學(xué)院司法鑒定中心1998年至2003年間受理的昆明地區(qū)涉及醫(yī)療爭議的死亡事件160例(包括醫(yī)療糾紛和非法行醫(yī)死亡案件)的法醫(yī)病理鑒定資料進行統(tǒng)計學(xué)分析研究,應(yīng)用法醫(yī)病理學(xué)死因分析理論,對醫(yī)療爭議死亡事件的司法鑒定問題進行探討。結(jié)果昆明地區(qū)醫(yī)療爭議死亡事件呈逐年上升趨勢,其中以育齡婦女發(fā)生死亡所占比率最高;其次是5歲以下小兒發(fā)生死亡;分娩中或分娩后胎兒迅速死亡居第三位;在后兩者中男性死亡發(fā)生率高于女性。在非法行醫(yī)死亡案件中,醫(yī)療過錯參與死因構(gòu)成的比率為88.89%。結(jié)論昆明地區(qū)醫(yī)療爭議死亡事件的臨床診斷符合率和醫(yī)療過錯發(fā)生率與國內(nèi)外相關(guān)報道基本一致。法醫(yī)學(xué)鑒定采用"六等九級法"對醫(yī)療爭議死亡事件中醫(yī)療過錯對死亡發(fā)生的作用及其參與度進行分析和評價,具有較強的可操作性和實用性。
[Abstract]:Objective to study the epidemiological characteristics of death events involving medical disputes in Kunming, and to discuss the forensic identification of medical disputes in order to prevent medical disputes effectively.Forensic identification and related legislation of medical dispute death events provide important practical and theoretical basis.Methods the forensic pathological data of 160 cases of medical disputes (including medical disputes and illegal medical deaths) accepted by the judicial identification center of Kunming Medical College from 1998 to 2003 were analyzed and analyzed statistically.Using the theory of forensic pathological cause of death, the problem of forensic identification of medical dispute death events is discussed.Results the death rate of women of childbearing age was the highest in Kunming, followed by death of children under 5 years old, and the third place was the rapid death of fetus in labor or after delivery, the death rate of medical disputes in Kunming area was increasing year by year, and the death rate of women of childbearing age was the highest.In the latter two cases, the mortality rate of males was higher than that of females.In the death cases of illegal medical practice, the proportion of medical fault involved in the cause of death was 88.89.Conclusion the coincidence rate of clinical diagnosis and the incidence of medical fault in Kunming area are consistent with those reported at home and abroad.The application of "sixth grade and ninth grade method" in forensic identification is an analysis and evaluation of the effect of medical fault on death and its participation in medical disputes, which has strong operability and practicability.
