【摘要】： 黑社會(huì)組織犯罪,在國際上也稱之為有組織犯罪,是當(dāng)今國際社會(huì)公認(rèn)的一種最高形態(tài)的犯罪形式,是當(dāng)代社會(huì)普遍關(guān)注的熱點(diǎn)犯罪問題。其犯罪程度的嚴(yán)重化,不但嚴(yán)重破壞了社會(huì)治安秩序和人民生命財(cái)產(chǎn)安全,還直接威脅到國家的政治穩(wěn)定和經(jīng)濟(jì)社會(huì)發(fā)展,日益成為世界各國普遍關(guān)注的一個(gè)嚴(yán)峻的社會(huì)問題。針對這一課題,本文擬對我國黑社會(huì)性質(zhì)組織犯罪的概念、特點(diǎn)等有關(guān)理論進(jìn)行分析,通過研究其成因及發(fā)展規(guī)律等問題,探求其立法、司法及社會(huì)綜合防治對策。 本文首先從黑社會(huì)性質(zhì)組織犯罪的有關(guān)理論出發(fā),對其相關(guān)概念、特征進(jìn)行了闡述,并分析其特點(diǎn)及發(fā)展趨勢。針對黑社會(huì)性質(zhì)組織犯罪成因的復(fù)雜性,本文從社會(huì)學(xué)和心理學(xué)的不同視角對我國現(xiàn)階段黑社會(huì)性質(zhì)組織犯罪的成因進(jìn)行綜合分析,認(rèn)為黑社會(huì)性質(zhì)組織犯罪的產(chǎn)生和發(fā)展,具有其社會(huì)、經(jīng)濟(jì)、政治、法律、文化、心理等多層面原因。因此,必須從多方面入手,對其進(jìn)行“標(biāo)本兼治”。 通過對黑社會(huì)性質(zhì)組織犯罪的成因進(jìn)行綜合分析,探求其防治對策,是本文研究的重點(diǎn)。筆者認(rèn)為,在宏觀方面,應(yīng)通過加強(qiáng)社會(huì)管理、健全社會(huì)結(jié)構(gòu)、減少社會(huì)矛盾、遏制腐敗現(xiàn)象,祛除滋生黑社會(huì)性質(zhì)組織犯罪的種種消極因素,從根本上有效預(yù)防和控制黑社會(huì)性質(zhì)組織犯罪的產(chǎn)生和發(fā)展。司法防控方面,各級司法機(jī)關(guān)要加強(qiáng)配合,建立專門機(jī)構(gòu)和專業(yè)隊(duì)伍,提高辦案水平,加強(qiáng)情報(bào)信息和基礎(chǔ)工作,與嚴(yán)打走私、販毒、洗錢等犯罪相結(jié)合,并加強(qiáng)國際交流合作,提高對黑社會(huì)性質(zhì)組織犯罪的打擊力度。 針對我國目前“反黑”立法的缺陷和滯后現(xiàn)象,本文認(rèn)為應(yīng)當(dāng)借鑒國外的先進(jìn)立法經(jīng)驗(yàn),結(jié)合我國的實(shí)際情況,在實(shí)體法和程序法方面繼續(xù)完善我國的“反黑”法律體系,以快速、高效的懲治和打擊黑社會(huì)性質(zhì)組織犯罪,適應(yīng)當(dāng)前斗爭形勢的需要,切實(shí)維護(hù)法律的尊嚴(yán)和社會(huì)的穩(wěn)定。
[Abstract]:Organized crime, which is also called organized crime in the world, is recognized as the highest form of crime by the international community. It is also a hot crime problem of the contemporary society.The severity of its crime not only seriously undermines the public security order and the safety of people's lives and property, but also directly threatens the political stability and economic and social development of the country, and has increasingly become a serious social problem of universal concern all over the world.In view of this subject, this paper intends to analyze the concept, characteristics and other related theories of the organized crime of underworld nature in our country, and through the study of its cause of formation and the law of its development and so on, to explore its legislative, judicial and social comprehensive prevention and cure countermeasures.Based on the theory of organized crime of underworld nature, this paper expounds its related concepts and characteristics, and analyzes its characteristics and development trend.In view of the complexity of the formation of the organized crime with the nature of the underworld, this paper makes a comprehensive analysis of the causes of the organized crime of the underworld nature in our country from the different angles of sociology and psychology, and concludes that the emergence and development of the organized crime of the nature of the underworld.There are many social, economic, political, legal, cultural, psychological and other reasons.Therefore, must start from many aspects, carries on to its "the symptom and the root".It is the focal point of this paper to analyze the causes of the organized crime of the underworld and to find out the prevention and cure measures.In the macroscopic aspect, we should strengthen the social management, perfect the social structure, reduce the social contradictions, curb the corruption, and eliminate the negative factors that breed the organized crime of the underworld.Fundamentally, effectively prevent and control the emergence and development of organized crime with underworld nature.With regard to judicial prevention and control, the judicial organs at all levels should strengthen cooperation, set up specialized agencies and professional teams, improve the level of handling cases, strengthen intelligence information and basic work, and combine them with crimes such as cracking down on smuggling, drug trafficking, money laundering, and other crimes.And to strengthen international exchanges and cooperation to improve the nature of organized crime in the fight against triad crime.In view of the defects and lags of the current "anti-triad" legislation in China, this paper holds that we should learn from the advanced legislative experience of foreign countries, combine the actual situation of our country, and continue to improve the "anti-triad" legal system in the aspect of substantive law and procedural law.In order to punish and crack down the organized crime of underworld character quickly and efficiently, adapt to the need of the current situation of struggle, safeguard the dignity of the law and the stability of the society.
