【摘要】： 隨著社會的發(fā)展,人類改造環(huán)境的能力得到了很大提升,特別是進(jìn)入工業(yè)社會之來,人類對環(huán)境的影響急劇加強(qiáng),大自然處處留下了人類的痕跡。在人類文明高度發(fā)達(dá)的今天環(huán)境問題不僅沒有很好地得到解決,而且不斷地升級,現(xiàn)代社會環(huán)境危機(jī)此起彼伏,生態(tài)狀況持續(xù)惡化�？梢哉f,上個世紀(jì)是有史以來環(huán)境破壞最為嚴(yán)重的一個世紀(jì),全世界的科學(xué)家都已經(jīng)指出,對資源的過度損耗,對生態(tài)環(huán)境的嚴(yán)重污染,正使人們面臨著前所未有的懲罰,這也將是人類當(dāng)前以及今后一段時間遇到的新的嚴(yán)峻挑戰(zhàn)。全球環(huán)境的嚴(yán)重破壞,迫使各國的立法者不得不采取各種法律保護(hù)措施來限制環(huán)境的進(jìn)一步惡化。在各種破壞環(huán)境的行為中,環(huán)境犯罪的社會危害性巨大,且給人類的生存和繁衍帶來了嚴(yán)重的威脅,隨著經(jīng)濟(jì)的發(fā)展和社會的快節(jié)奏進(jìn)步,我國的環(huán)境犯罪問題也日趨嚴(yán)重。因此,環(huán)境犯罪的原因與因應(yīng)措施的研究對于打擊環(huán)境犯罪、保護(hù)環(huán)境有十分重要的意義。 本文立足于從環(huán)境犯罪的原因及因應(yīng)措施的角度出發(fā)去研究環(huán)境犯罪的相關(guān)理論問題。文章首先界定了環(huán)境犯罪的概念、歸納了環(huán)境犯罪的特征、介紹了環(huán)境犯罪的范圍、闡述了現(xiàn)階段我國環(huán)境犯罪的嚴(yán)峻現(xiàn)狀。其次,從國家立法缺陷、政府執(zhí)法不嚴(yán)、企業(yè)追求高利潤以及個人環(huán)保意識薄弱的視角分析了環(huán)境犯罪頻發(fā)的原因。并針對各原因提出了完善立法、提高執(zhí)法質(zhì)量、加強(qiáng)企業(yè)生產(chǎn)引導(dǎo)以及提高公眾環(huán)保意識的對策。最后,筆者認(rèn)為只有從國家、政府、企業(yè)、個人等方面全方位的思考環(huán)境犯罪的因應(yīng)措施,才能有效的打擊和預(yù)防環(huán)境犯罪。本文的初淺與不足之處還有待后人的進(jìn)一步研究與完善。
[Abstract]:With the development of society, the ability of human beings to transform the environment has been greatly improved, especially in the industrial society, the impact of human on the environment has been strengthened sharply, and nature has left human traces everywhere.In the highly developed human civilization today, the environmental problems not only have not been well solved, but also continue to upgrade, modern social environmental crisis one after another, ecological conditions continue to deteriorate.It can be said that the last century was the most serious environmental damage in history. Scientists all over the world have pointed out that the excessive depletion of resources and the serious pollution of the ecological environment are making people face unprecedented punishment.It will also be a new and severe challenge for humanity now and for some time to come.The serious damage to the global environment forces the legislators of various countries to take all kinds of legal protection measures to limit the further deterioration of the environment.Among all kinds of actions to destroy the environment, the social harm of environmental crime is great, and it brings serious threat to the survival and reproduction of human beings. With the development of economy and the rapid progress of society, the environmental crime problem in our country is becoming more and more serious.Therefore, the study of the causes and countermeasures of environmental crime is of great significance to combat environmental crime and protect the environment.Based on the reasons of environmental crime and the corresponding measures, this paper studies the related theoretical problems of environmental crime.This paper first defines the concept of environmental crime, summarizes the characteristics of environmental crime, introduces the scope of environmental crime, and expounds the severe situation of environmental crime in China at present.Secondly, from the point of view of the defects of national legislation, the lax enforcement of laws by the government, the pursuit of high profits by enterprises and the weak awareness of personal environmental protection, the reasons for the frequent occurrence of environmental crimes are analyzed.The countermeasures of perfecting legislation, improving the quality of law enforcement, strengthening the production guidance of enterprises and raising public awareness of environmental protection are put forward.Finally, the author believes that only from the state, government, enterprises, individuals and other aspects of the overall thinking of environmental crime countermeasures, in order to effectively combat and prevent environmental crime.The initial and deficiency of this paper need to be further studied and perfected.
