【摘要】： 宗族作為我國封建社會(huì)的產(chǎn)物,在新中國成立后一度銷聲匿跡,但隨著農(nóng)村社會(huì)中權(quán)力真空的出現(xiàn),宗族以寄生性的形態(tài)開始在在農(nóng)村中復(fù)興,并且全面介入農(nóng)村的政治、經(jīng)濟(jì)和文化生活之中。宗族勢力的活動(dòng)常常與國家權(quán)力和法律有著不可調(diào)和的矛盾,由此造成的宗族勢力犯罪問題日益嚴(yán)重,已經(jīng)對建設(shè)社會(huì)主義新農(nóng)村構(gòu)成了極大的威脅,嚴(yán)重地影響了農(nóng)村社會(huì)的穩(wěn)定和發(fā)展。因此,系統(tǒng)地研究我國農(nóng)村宗族勢力犯罪具有重大的理論和現(xiàn)實(shí)意義。 根據(jù)我國農(nóng)村宗族復(fù)興的研究現(xiàn)狀,筆者對農(nóng)村宗族勢力犯罪的概念進(jìn)行了重新界定,通過典型案例運(yùn)用社會(huì)學(xué)的分析方法從組織性質(zhì)和活動(dòng)結(jié)構(gòu)兩個(gè)方面具體分析了我國農(nóng)村宗族勢力犯罪的社會(huì)危害及類型、特征。 運(yùn)用系統(tǒng)結(jié)構(gòu)犯罪原因論分析了我國農(nóng)村宗族勢力犯罪的原因。一方面,從宗族勢力與農(nóng)村權(quán)力結(jié)構(gòu)的關(guān)系分析了我國農(nóng)村宗族勢力犯罪的社會(huì)原因。宗族勢力能夠在農(nóng)村權(quán)力結(jié)構(gòu)中扮演著重要的角色,主要是有三個(gè)網(wǎng)絡(luò)在支持宗族勢力。一是宗族經(jīng)濟(jì)支持網(wǎng),即宗族勢力的活動(dòng)主要是為了維護(hù)宗族及其成員在農(nóng)村中的經(jīng)濟(jì)地位和經(jīng)濟(jì)利益；二是宗族組織支持網(wǎng),宗族勢力利用農(nóng)村基層自治制度的不成熟,通過控制村委會(huì)等基層組織構(gòu)筑了一道在宗族和國家權(quán)力之間的緩沖帶,企圖阻擋國家權(quán)力對宗族勢力的沖擊；三是宗族文化支持網(wǎng),宗族存在和復(fù)興的基礎(chǔ)是成員之間的相互認(rèn)同,建立能夠推進(jìn)宗族壯大的宗族文化成為了宗族勢力的目標(biāo)。農(nóng)村宗族勢力與國家權(quán)力爭奪農(nóng)村政治、經(jīng)濟(jì)、文化資源是其犯罪的主要社會(huì)原因。另一方面,從犯罪心理學(xué)的角度分析了我國農(nóng)村宗族勢力犯罪的個(gè)體原因。 根據(jù)我國農(nóng)村宗族勢力犯罪的形成原因,提出了預(yù)防和控制我國農(nóng)村宗族勢力犯罪的對策。對我國農(nóng)村宗族勢力犯罪的預(yù)防和控制應(yīng)從兩方面采取措施：一是對我國農(nóng)村宗族勢力犯罪預(yù)防和控制的社會(huì)對策,包括發(fā)展農(nóng)村民主、推進(jìn)市場經(jīng)濟(jì)、普及法制教育、加強(qiáng)社會(huì)治安綜合管理；二是對我國農(nóng)村宗族勢力犯罪的刑事法律對策,包括完善對宗族勢力犯罪的刑事立法和健全對農(nóng)村宗族勢力犯罪的司法制度。
[Abstract]:The clan as a product of China's feudal society, in the new China after the establishment of once disappeared, but with a power vacuum in rural society, the clan began to form in the revival of parasitic in the rural areas, and fully involved in the rural areas of political, economic and cultural life. The clan activities often irreconcilable contradiction with state power and law, the clan forces crime problem resulting from the increasingly serious, has posed a great threat to the construction of new socialist countryside, and seriously affected the stability and development of rural society. Therefore, the system of rural clan force crime is of great theoretical and practical significance.
According to the current research status of the revival of our country rural clan, the author redefines the concept of rural clan crime, through the typical case analysis using the sociological method detailed analysis of China's rural clan crime social harm and the type of features from the two aspects of organization structure and nature activities.
Analysis on the causes of China's rural clan force crime causes of crime by system structure. On the one hand, analyze the social reasons of the rural clan force crimes from the relationship between clan forces and the rural power structure. The clan forces can play an important role in the rural power structure, there are three main network in support of the clan one is the clan forces. The economic support network, namely the clan activities mainly in order to maintain the clan and its members in rural areas in the economic status and economic benefits; two is the clan organization support network, the clan forces of rural grassroots self-government system is not mature, through the control of village committees and other grassroots organizations to build a road between the clan and the state power of the buffer zone, trying to block the state power to the clan clan culture shock; three is the basis of existence and support network, clan revival is among the members of the With the establishment of mutual recognition, can promote the growth of the clan clan culture became the clan target. The rural clan force and the state power for the rural political, economic, and cultural resources is the main social reasons of their crimes. On the other hand, analysis of the individual reasons of China's rural clan force crime from criminal psychology perspective.
According to the causes of the rural clan force crimes, and puts forward some countermeasures for prevention and control of rural clan force crimes. Take measures to prevent and control from two aspects of China's rural clan crime: one is the social countermeasures of China's rural clan force crime prevention and control, including the development of rural democracy, promote the market economy, the popularization of legal education, strengthen the comprehensive management of social security; two is the criminal legal countermeasure of our country rural clan force crimes, including the improvement of the clan crime criminal legislation and perfecting of the rural clan force criminal judicial system.
