【摘要】： 恢復(fù)性司法自傳入我國以來已經(jīng)成為刑事法學(xué)界研究的熱點(diǎn),其所內(nèi)涵的修復(fù)理念在現(xiàn)行刑事司法制度對(duì)犯罪顯得有些無能為力的情況下受到了人們的青睞,如今雖然對(duì)于它的效果和可行性還存在不少質(zhì)疑,但在許多國家已經(jīng)發(fā)展成為比較成熟的處理犯罪的模式,在非監(jiān)禁刑中也得到了廣泛的適用。許多發(fā)達(dá)國家和地區(qū)借鑒了恢復(fù)性司法理念對(duì)刑事司法制度做出了變革,尤其是在社區(qū)矯正的決定和執(zhí)行制度上做出了很多的創(chuàng)新,改變了過去那種以犯罪人為中心的模式,更加注重多種價(jià)值的實(shí)現(xiàn)。本文意在以恢復(fù)性司法的理念審視我國正在開展的社區(qū)矯正實(shí)踐,為在社區(qū)矯正中引入恢復(fù)性司法的理念作出有益的探索。本文共分為四個(gè)部分,第一章主要是對(duì)社區(qū)矯正和恢復(fù)性司法的概念以及二者之間的關(guān)系作出界定；第二章著重闡述我國目前社區(qū)矯正的實(shí)踐情況和存在的問題：第三章論述社區(qū)矯正引入恢復(fù)性司法理念的意義和可行性,先是對(duì)恢復(fù)性司法的理念作出明確解析,隨后指出恢復(fù)性司法對(duì)社區(qū)矯正的意義,最后闡述了社區(qū)矯正引入恢復(fù)性司法理念的可行性；第四章先考察了域外社區(qū)矯正與恢復(fù)性司法的結(jié)合之路,然后從社區(qū)預(yù)防、恢復(fù)性社區(qū)矯正決定和社區(qū)矯正執(zhí)行三個(gè)階段提出了恢復(fù)性司法視野下我國社區(qū)矯正制度的完善進(jìn)路。
[Abstract]:Restorative justice has become a hot topic in the field of criminal law since it was introduced into our country.Although there are still many doubts about its effect and feasibility, it has developed into a more mature mode of dealing with crimes in many countries, and has also been widely applied in non-custodial punishment.Many developed countries and regions have adopted the concept of restorative justice to transform the criminal justice system, especially in the decisions and enforcement systems of community correction, which have changed the past pattern of focusing on offenders.Pay more attention to the realization of a variety of values.The purpose of this paper is to examine the practice of community correction in our country with the concept of restorative justice, and to make a beneficial exploration for introducing the concept of restorative justice into community correction.This paper is divided into four parts. The first chapter mainly defines the concepts of community correction and restorative justice and the relationship between them.The second chapter focuses on the practice and existing problems of community correction in our country. The third chapter discusses the significance and feasibility of introducing restorative justice into community correction, and first makes a clear analysis of the concept of restorative justice.Then it points out the significance of restorative justice to community correction, and finally expounds the feasibility of introducing the concept of restorative justice into community correction. Chapter four first examines the combination of community correction and restorative justice, and then from community prevention,The decision of restorative community correction and the implementation of community correction put forward the way to perfect the system of community correction in the view of restorative justice.
