【摘要】：自改革開(kāi)放以來(lái),溫州農(nóng)村發(fā)展程度隨著溫州經(jīng)濟(jì)的快速增長(zhǎng)也水漲船高,同時(shí)也涌現(xiàn)了諸多經(jīng)濟(jì)犯罪的問(wèn)題,尤其是2010年以來(lái)爆發(fā)的民間非法集資類犯罪問(wèn)題,這與溫州地區(qū)特殊的經(jīng)濟(jì)、社會(huì)特點(diǎn)有關(guān)。溫州市農(nóng)村部分地區(qū)有非常眾多的中小型企業(yè),這些中小型企業(yè)的發(fā)展并不樂(lè)觀,沒(méi)有成熟的企業(yè)發(fā)展模式,資金容易造成缺口,并且不易通過(guò)正規(guī)渠道獲得資金,只能依靠溫州地區(qū)的民間融資。溫州人重商,民間有濃厚的民間借貸氛圍和傳統(tǒng),民眾對(duì)集資的接受程度較高,這形成了溫州市農(nóng)村地區(qū)非法集資活動(dòng)的歷史根源。不斷發(fā)生的非法集資類犯罪給予溫州的整個(gè)實(shí)體經(jīng)濟(jì)以沉重打擊,其中尤以溫州的農(nóng)村地區(qū)影響甚大,如何更好地預(yù)防和解決農(nóng)村經(jīng)濟(jì)犯罪問(wèn)題以及相應(yīng)的次生問(wèn)題已逐漸成為溫州市農(nóng)村地區(qū)發(fā)展的重要問(wèn)題。本文以理論聯(lián)系實(shí)際的方式,通過(guò)查閱相關(guān)文獻(xiàn)及國(guó)內(nèi)外發(fā)展現(xiàn)狀資料,了解國(guó)內(nèi)外現(xiàn)有的非法集資現(xiàn)狀及相關(guān)的研究進(jìn)展,對(duì)資料進(jìn)行整理歸納,對(duì)我國(guó)的非法集資現(xiàn)狀提煉與分析,總結(jié)不足,提出問(wèn)題。然后通過(guò)實(shí)地調(diào)研的方法,收集到有關(guān)溫州農(nóng)村地區(qū)經(jīng)濟(jì)社會(huì)發(fā)展以及非法集資的第一手資料。通過(guò)對(duì)這些第一手資料的整理歸納,再結(jié)合對(duì)溫州當(dāng)?shù)鼐唧w的非法集資類犯罪案例的分析來(lái)研究溫州地區(qū)的非法集資起因、特點(diǎn)、演變等,最后根據(jù)當(dāng)?shù)貙?shí)際情況結(jié)合前人研究成果提出相應(yīng)的預(yù)防措施。通過(guò)調(diào)研分析,發(fā)現(xiàn)溫州農(nóng)村地區(qū)非法集資類犯罪有幾個(gè)顯著的特點(diǎn):涉案金額巨大、犯罪手段多樣化、時(shí)間跨度較長(zhǎng)、牽涉人數(shù)眾多。溫州農(nóng)村非法集資類犯罪的高發(fā)經(jīng)分析主要原因?yàn)?溫州農(nóng)村經(jīng)濟(jì)體的快速發(fā)展導(dǎo)致非法集資類犯罪由城市轉(zhuǎn)向農(nóng)村、農(nóng)民預(yù)期回報(bào)高昂是民間參與非法集資的內(nèi)在動(dòng)力、農(nóng)民對(duì)非法集資類犯罪認(rèn)知不足是非法集資的外在條件、相關(guān)部門對(duì)農(nóng)村地區(qū)重視不足、監(jiān)管缺位是非法集資犯罪頻發(fā)的關(guān)鍵要素。接著,對(duì)立人集團(tuán)非法集資案件和龍灣區(qū)王某某等人的非法集資案件進(jìn)行了著重分析,從其產(chǎn)生原因、特點(diǎn)、危害性及后續(xù)處置入手,結(jié)合其所處地區(qū)的實(shí)際社會(huì)、經(jīng)濟(jì)情況研究溫州農(nóng)村地區(qū)非法集資類犯罪的產(chǎn)生原因、特點(diǎn)及危害性。最后提出相應(yīng)的綜合預(yù)防措施:1、提高認(rèn)識(shí),加強(qiáng)非法集資類犯罪在溫州農(nóng)村地區(qū)的宣傳;2、加強(qiáng)溫州民間金融的監(jiān)管力度,扼殺農(nóng)村非法集資的死灰復(fù)燃;3、公檢法機(jī)關(guān)要加大對(duì)非法集資類案件的處置力度,給予犯罪分子以強(qiáng)力震懾作用;4、以溫州農(nóng)村非法集資犯罪為典型,努力促進(jìn)民間金融的借貸的獨(dú)立立法;5、拓寬中小企業(yè)融資渠道。
[Abstract]:Since the reform and opening up, the level of rural development in Wenzhou has increased with the rapid economic growth in Wenzhou. At the same time, many problems of economic crimes have emerged, especially the problem of private illegal fund-raising crimes that have erupted since 2010.This with Wenzhou area special economy, social characteristic is concerned.There are a large number of small and medium-sized enterprises in some rural areas of Wenzhou. The development of these small and medium-sized enterprises is not optimistic. There is no mature enterprise development model, and capital is easy to create a gap, and it is not easy to obtain funds through formal channels.Wenzhou can only rely on private financing.Wenzhou people favor business, folk have a strong folk lending atmosphere and tradition, the people of the higher acceptance of fund-raising, which formed the historical roots of illegal fund-raising activities in rural areas of Wenzhou.The continuing illegal fund-raising crimes have dealt a heavy blow to the whole real economy of Wenzhou, especially in the rural areas of Wenzhou.How to better prevent and solve the problem of rural economic crime and the corresponding secondary problems has gradually become an important issue in the development of Wenzhou rural areas.In this paper, by referring to relevant literature and domestic and foreign development status, we can find out the current situation of illegal financing and related research progress at home and abroad, and then sort out and sum up the data.Abstract and analyze the current situation of illegal fund-raising in China, summarize the deficiency and put forward problems.Then through the method of field investigation, we collect first-hand information about the economic and social development and illegal raising of funds in Wenzhou rural areas.Through the collation and induction of these first-hand materials and the analysis of the specific cases of local illegal fund-raising crimes in Wenzhou to study the causes, characteristics and evolution of illegal fund-raising in Wenzhou,Finally, according to the local actual situation combined with previous research results, the corresponding preventive measures are put forward.Through investigation and analysis, it is found that there are several remarkable characteristics of illegal fund-raising crimes in rural areas of Wenzhou: the amount of money involved is huge, the means of crime are diversified, the time span is longer, and the number of people involved is numerous.The main reasons for the high incidence of illegal fund-raising crimes in Wenzhou rural areas are as follows: the rapid development of Wenzhou rural economy leads to the shift of illegal fund-raising crimes from urban to rural areas, and the high expected return of farmers is the intrinsic motive force for private participation in illegal fund-raising.Farmers' lack of awareness of illegal fund-raising crimes is the external condition of illegal fund-raising, the relevant departments pay less attention to rural areas, and the lack of supervision is the key element of illegal fund-raising crimes.Then, the case of illegal raising of funds by rival groups and those of Wang and so on in Longwan District are analyzed emphatically, starting with the causes, characteristics, harmfulness and subsequent disposal of the cases, and combining with the actual society of the region in which they live.This paper studies the causes, characteristics and harmfulness of illegal fund-raising crimes in Wenzhou rural areas.Finally, we put forward the corresponding comprehensive preventive measures: 1, raise awareness, strengthen the propaganda of illegal fund-raising crimes in Wenzhou rural areas, and strengthen the supervision and control of Wenzhou folk finance.To stifle the resurgence of illegal fund-raising in rural areas, the public security bureau, procuratorates, and court organs should increase the handling of illegal fund-raising cases and give criminal elements a powerful deterrent role. This is exemplified by the crime of illegally raising funds in rural areas of Wenzhou.Efforts to promote private finance lending independent legislation to broaden the financing channels for small and medium-sized enterprises.
