【摘要】：刑警法學(xué)的結(jié)構(gòu)比主要研究刑警法學(xué)中罪體、責(zé)體與刑體的結(jié)構(gòu)比重關(guān)系。整體上,刑警法學(xué)的結(jié)構(gòu)比重關(guān)系基本屬于重罪體與輕責(zé)體、微刑體比重關(guān)系。該定律對(duì)明確公安刑事執(zhí)法的主次矛盾及層次性具有現(xiàn)實(shí)的指導(dǎo)意義。在有關(guān)罪體、責(zé)體與刑體三大組成成分中,罪體的重型比重關(guān)系屬于主要成分的關(guān)鍵組成要素,具有十分明顯的重要性和影響力;而責(zé)體與刑體的輕微比重關(guān)系屬于非主要成分,只有微不足道的薄弱的影響力。合理化的刑警法學(xué)結(jié)構(gòu)比,必將提升刑警法學(xué)的教學(xué)質(zhì)量和水平,也將有利于刑警法學(xué)學(xué)科的深入發(fā)展。
[Abstract]:The structure ratio of criminal law is mainly concerned with the relationship between the criminal body, the criminal body and the criminal body.On the whole, the relation of criminal law structure proportion belongs to felony body and light responsibility body.The law is of practical significance to clarify the principal and secondary contradictions and levels of public security criminal law enforcement.Among the three components of the crime body, the responsibility body and the criminal body, the heavy proportion relation of the crime body belongs to the key constituent element of the main component, and has very obvious importance and influence.The minor proportion of responsibility and punishment belongs to the non-main component, and has only insignificant and weak influence.The rational structure ratio of criminal police law will certainly improve the teaching quality and level of criminal police law, and will also benefit the further development of the subject of criminal police law.
