【摘要】： 網(wǎng)絡(luò)生活方式的普及是科技、社會(huì)發(fā)展的重要體現(xiàn)形式,網(wǎng)絡(luò)社區(qū)逐漸成為人們不可或缺的生活、娛樂平臺(tái)。網(wǎng)絡(luò)社區(qū)之中人們的互動(dòng)具有極高的擬真性,因此必然存在某些稀缺物品的需求以及物品之間、物品與服務(wù)之間、服務(wù)之間的交易,它們兩者共同促成網(wǎng)絡(luò)虛擬財(cái)產(chǎn)的產(chǎn)生。網(wǎng)絡(luò)虛擬財(cái)產(chǎn)具有相當(dāng)?shù)膬r(jià)值,可以與現(xiàn)實(shí)世界中的財(cái)產(chǎn)和貨幣兌換、交易,因此存在較大的需求空間形成了較穩(wěn)定的利益鏈條。由于有利益的地方就必然有犯罪的滋生,這樣面對網(wǎng)絡(luò)虛擬財(cái)產(chǎn)所蘊(yùn)含的極大利益誘惑,致使許多社會(huì)中的不安定份子選擇鋌而走險(xiǎn)走上犯罪道路。針對網(wǎng)絡(luò)虛擬財(cái)產(chǎn)的犯罪以網(wǎng)絡(luò)盜竊居多。 盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪,由于其產(chǎn)生、實(shí)施過程中參入有高科技成分,從而使得它與傳統(tǒng)型的盜竊犯罪相比具有相當(dāng)?shù)男绿攸c(diǎn):從盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的犯罪人角度來說,第一,犯罪人平均年齡普遍呈現(xiàn)低齡化特點(diǎn)。據(jù)統(tǒng)計(jì),我國的計(jì)算機(jī)犯罪者,平均年齡也是25歲;第二,犯罪人普遍掌握較高計(jì)算機(jī)技術(shù),能夠較為熟練的掌握一些具有較高科技含量的計(jì)算機(jī)軟件、工具。從盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的被害人角度來說,被害人主要包括經(jīng)常上網(wǎng)特別是經(jīng)常玩網(wǎng)絡(luò)游戲且大多是屬于對計(jì)算機(jī)知識(shí)不太了解的人;被害人的主觀方面的特征主要表現(xiàn)為法律意識(shí)不強(qiáng)、粗心大意、貪圖小便宜等方面。從盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的手段特性角度來說,其主要類型包括原始型和高科技型兩種,且具有相當(dāng)?shù)男路f性和隱蔽性。從盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的犯罪對象來說,主要有電子貨幣、虛擬物品、電子賬戶幾種類型,這些對象都包含有較高的科技含量,因而是有相當(dāng)?shù)男路f性的。 盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪產(chǎn)生原因復(fù)雜,從其社會(huì)原因來說,主要有社會(huì)針對盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的認(rèn)識(shí)不足、針對盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的立法有所疏失,政府對網(wǎng)絡(luò)空間監(jiān)管乏力、針對盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的司法打擊力度疲軟等幾個(gè)方面。同時(shí)社會(huì)防治盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪也有客觀困難。從盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的被害人方面的原因來說主要有被害人的網(wǎng)絡(luò)技術(shù)水平較低,被害人對網(wǎng)絡(luò)犯罪防范意識(shí)較低等方面。 盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪猖獗因此必須有針對性的提出相應(yīng)地防治措施方案。一方面來說要做好對該類犯罪的事先預(yù)防工作措施,主要包括以下幾點(diǎn):首先,應(yīng)當(dāng)切實(shí)提高立法重視程度;其次,著力加強(qiáng)對網(wǎng)絡(luò)虛擬財(cái)產(chǎn)的監(jiān)管;再次,加強(qiáng)對民眾的防范意識(shí)教育;最后,加大對民眾的計(jì)算機(jī)網(wǎng)絡(luò)基本技術(shù)普及教育的力度。 另一方面來說要加大對該類犯罪的事后打擊力度。首先,要加大對網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的司法打擊力度;其次,要努力提高國家機(jī)關(guān)監(jiān)管、偵查盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪所必須的技術(shù)、設(shè)施水平。 盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪與現(xiàn)實(shí)中的犯罪一樣,不僅可以預(yù)見,同時(shí)也是可以被預(yù)防控制的。對付這種犯罪時(shí)大可不必由于其高科技屬性而產(chǎn)生不必要的顧慮。對盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的防治需要社會(huì)各界聯(lián)手群策群力制定出符合實(shí)際,符合中國國情的刑事策略,以有效的防治該種犯罪,避免其進(jìn)一步擴(kuò)散蔓延造成更大的損失。
