【摘要】： 勞動(dòng)教養(yǎng)是對(duì)有違法和輕微犯罪行為人實(shí)行強(qiáng)制性教育改造的中國(guó)特有一種法律制度。勞動(dòng)教養(yǎng)執(zhí)行是指有勞動(dòng)教養(yǎng)執(zhí)行權(quán)利的部門對(duì)違法和輕微犯罪行為人進(jìn)行矯正違法行為的過程。近半個(gè)世紀(jì)來,通過執(zhí)行勞動(dòng)教養(yǎng)制度教育、感化和挽救了一大批違法犯罪人員,為鞏固新生的人民民主政權(quán),促進(jìn)社會(huì)主義依法治國(guó)進(jìn)程起到了非常重要的作用。然而,勞動(dòng)教養(yǎng)執(zhí)行制度尚未完全適應(yīng)我國(guó)法治進(jìn)程的需要,在勞動(dòng)教養(yǎng)執(zhí)行過程中缺乏監(jiān)督檢察制度約束,以致于勞動(dòng)教養(yǎng)執(zhí)行過程中權(quán)力腐敗影響社會(huì)公平正義,侵害當(dāng)事人的權(quán)益,它與我國(guó)日益重視人權(quán)的司法保護(hù)發(fā)展趨勢(shì)不符。本文試圖通過對(duì)我國(guó)勞動(dòng)教養(yǎng)執(zhí)行制度的歷史和現(xiàn)實(shí)考察,剖析其存在的理論缺陷與實(shí)踐不足,并從理想與現(xiàn)實(shí)結(jié)合的視角,對(duì)探索建立勞動(dòng)教養(yǎng)執(zhí)行檢察監(jiān)督制度的路徑和方法做出了大膽設(shè)想。 本文共分為四個(gè)部分： 第一部分是對(duì)勞動(dòng)教養(yǎng)制度的形成做了簡(jiǎn)要概括,從而總結(jié)歸納出勞動(dòng)教養(yǎng)執(zhí)行的概念、性質(zhì)和特征。文章對(duì)勞動(dòng)教養(yǎng)法律地位進(jìn)行了概括并對(duì)工作實(shí)踐中勞動(dòng)教養(yǎng)執(zhí)行中存在的問題進(jìn)行了重點(diǎn)分析。 第二部分對(duì)勞動(dòng)教養(yǎng)執(zhí)行引入檢察監(jiān)督的必要性、可行性和現(xiàn)實(shí)性以理論和現(xiàn)實(shí)相結(jié)合的方式進(jìn)行了詳細(xì)的剖析和探討。 第三部分對(duì)勞動(dòng)教養(yǎng)執(zhí)行的立法現(xiàn)狀進(jìn)行了簡(jiǎn)要概括,并將其與國(guó)外相似制度進(jìn)行了比較。文章歸納了勞動(dòng)教養(yǎng)執(zhí)行檢察監(jiān)督缺失導(dǎo)致的困惑,并對(duì)造成這種情況的原因深入進(jìn)行了分析和探討。文章還對(duì)當(dāng)前勞動(dòng)教養(yǎng)執(zhí)行檢察監(jiān)督方式缺失及原因進(jìn)行了分析研究。 第四部分重點(diǎn)提出了對(duì)勞動(dòng)教養(yǎng)執(zhí)行檢察監(jiān)督制度的構(gòu)想,并從立法原則、指導(dǎo)思想、具體制度、相關(guān)措施及程序進(jìn)行了大膽的設(shè)想,指出應(yīng)將檢察監(jiān)督盡快引入勞動(dòng)教養(yǎng)執(zhí)行中,不斷完善勞動(dòng)教養(yǎng)制度的合法性和合理性,最終實(shí)現(xiàn)構(gòu)建公平正義的有序社會(huì)。
[Abstract]:The reeducation through labor is a unique legal system in China which has compulsory education reform for people with illegal and minor crimes . The implementation of reeducation through reeducation is the process of correcting the illegal and minor criminal acts . In the last half of the century , the system of reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through reeducation through labour reeducation .



This paper is divided into four parts :



The first part is a brief summary of the formation of the system of reeducation through labor , so as to summarize the concept , nature and characteristics of the implementation of reeducation through labor .



In the second part , the necessity , feasibility and reality of introducing procuratorial supervision into the execution of labor education are analyzed and discussed in detail with the combination of theory and reality .



In the third part , the present situation of the legislation of reeducation through labor is briefly summarized and compared with the foreign similar system . The article sums up the confusion caused by the lack of supervision and supervision of labor education , and analyzes and discusses the causes of this situation .



The fourth part puts forward the idea of carrying out the procuratorial supervision system for the reeducation through labor , and carries on the bold idea from the legislative principle , the guiding ideology , the concrete system , the relevant measures and procedures , and points out that the procuratorial supervision should be introduced into the implementation of the reeducation through labor as soon as possible , and the legitimacy and rationality of the system of reeducation through labor should be perfected , and the orderly society of fair and justice is finally achieved .
