【摘要】： 隨著改革開放的進(jìn)一步深入和社會主義市場經(jīng)濟(jì)的發(fā)展,我國城市各類車量的保有量迅速增長,社會經(jīng)濟(jì)和生活節(jié)奏明顯加快。城市交通出行狀況日趨嚴(yán)峻,面對日益復(fù)雜的交通秩序管理工作,各級公安機關(guān)交通管理部門面臨空前的工作壓力。交通警察依法對交通違法行為實施行政處罰是交通管理工作的重要手段之一。隨著人權(quán)觀念的深化,人民群眾的法律意識不斷增強,他們對交警執(zhí)法的要求也越來越高。如何在新的歷史時期,排除和克服影響交警執(zhí)法行為的不利因素,將交警執(zhí)法的整體水平推上一個新的臺階是擺在我們每一位普通交警面前嚴(yán)峻而又緊迫的現(xiàn)實課題。 本文研究主要是:一、以本人親生經(jīng)歷的一起行政復(fù)議案件為背景,深入剖析交警在行政執(zhí)法過程中的違法行為和導(dǎo)致違法行為背后的影響因素。通過個案分析得出制度層面上現(xiàn)行法律依據(jù)和微觀層面上交警本人的素質(zhì)因素構(gòu)成了影響交警執(zhí)法行為的主要原因。二、在科學(xué)分類的基礎(chǔ)上結(jié)合南通的實際情況,為適應(yīng)當(dāng)前交通管理的現(xiàn)狀,提出一些排除和克服影響交警執(zhí)法行為因素的方式和方法。
[Abstract]:With the further deepening of the reform and opening up and the development of the socialist market economy, the quantity of various types of vehicles in cities in our country has increased rapidly, the social economy and the pace of life have been obviously accelerated, and the situation of urban transportation and travel has become increasingly serious. In the face of increasingly complex traffic order management, Traffic management departments of public security organs at all levels face unprecedented work pressure. Traffic police impose administrative punishment on traffic violations according to law is one of the important means of traffic management. With the deepening of the concept of human rights, The people's legal consciousness is increasing, and their demands on traffic police law enforcement are becoming higher and higher. In the new historical period, how to eliminate and overcome the unfavorable factors that affect the traffic police's law enforcement behavior, To push the law enforcement level of traffic police up to a new level is a serious and urgent practical task for every ordinary traffic policeman. The main research of this paper is as follows: first, based on the background of an administrative reconsideration case that I have experienced in my own life, Deeply analyze the illegal behavior of the traffic police in the course of administrative law enforcement and the influencing factors behind the illegal behavior. Through the case analysis, we can get the current legal basis on the system level and the constitution of the quality factor of the traffic policeman on the micro level. The main reasons that affect the law enforcement behavior of the traffic police are as follows. On the basis of scientific classification, combined with the actual situation of Nantong, in order to adapt to the current situation of traffic management, this paper puts forward some ways and methods to eliminate and overcome the factors affecting the law enforcement behavior of traffic police.
